Trying To Fix Credit Report

    Well, back in May I stared to clean up my credit report. First USA was the only problem and except for Equifax (which fixed First USA properly) the other 2 (TransUnion and Experian) need to be fixed.
    I sent off a dispute to TransUnion and they reported back that first USA was reporting correctly.

    I sent a new dispute saying that they wern't reporting correctly and they were included in a chapter 7 BK.

    Now they sent me a letter saying that they previously verified the First USA account as accurate and under the FCRA, they consider my dispute "Frivolous" and they will not re-investigate.....unless I sent them all the documentation.

    I thought that the agency has to investigate and report back to the consumer ..... and not the consumer that has to investigate and report back to the agency. Heck, if they look at their own credit report they sell to me, it shows the bankruptcy, case number, filed date, discharged date....ect. Doesn't that give them a clue?

    Oh well, I'm firing off a rebuttle letter on Monday basically telling them where they can look for supporting evidence of my dispute and if they need my help to do their investigation for them, I am available for a fee.

    Well, since the first post, I sent 2 more disputes and got 2 more Frivolous Dispute letters back.

    This time I sent a letter:

    "INTENT TO FILE FORMAL FTC COMPLAINT"

    The letter is about 4 pages long listing the dates of the previous disputes and the responses. I also listed out the bankruptcy time frame for them and gave them a link to the US Bankruptcy Electronic records (PACER).

    TransUnion wanted my discharge papers which I won't send because they don't serve the purpose of showing who was included in the Bankruptcy. They need to get the service papers for that (I don't have those) off PACER. Those are the papers that show who was served the Bankruptcy papers and discharge papers along with the dates......which will show the account was still open when I file BK and it should not be a charge-off.

    Lets see how they will respond. If they do nothing, I will then file the formal complaint with the FTC.

    If they want me to do all the research for them, I am available for a fee.

    What about writing the OC to have them submit as IIB to the CRAs?

    I have already written to the OC (FirstUSA) and nothing was done.

    This means nothing to them, only a court complaint will get their attention!

    I have to build up an 'Audit Trail' as evidence of my attempts to correct the credit report.

    I will make sure that I have more than enough rope to hang'em.

    Got my new TransUnion Report back. Boy, they are screwed up.

    The FirstUSa account I disputed, shows it was sold to Weinstein, but still has a balance due and past due amount.

    TransUnion will not reinvestigate the FirstUSa chargeoff no matter if I send them documentation or not. They just say it was previously verified.

    How can companies like this get away with breaking the law? Oh, I know....the FTC will not do a dang thing to them.

    I am in the exact same situation, except TU is NOT reporting "sold to Weinstein". Only Experian is. And, they still list balances.

    Let me know if you have any updates.
