TU, Gold Key Credit, and HIPAA

    I screwed up and sent letters to TransUnion and Equifax the day before I found this message board.

    Here's a shortened version of the story....Pulled credit report, found $2000 worth of medical bills. Was trying to be a "good" person and pay them. Called MECCLR, was sent to Gold Key Credit (GKC)who has 3 of the 9 accounts and made payment arrangements (Dumb, I know.), but also asked for dates of service.

    Called TennCare, discovered that I DID have TennCare (TN's Medicaid Program) coverage for 1 of the accounts with GKC and 2 of the 6 accounts with the other CA. Also discovered that the Service Provider violated TennCare MEdicaid Rule 1200-13-13.08 which states that they CANNOT seek payment from an enrollee under like 5 conditions. One was failure of MCO to pay claims, and another was failure to re-submit. Filed an appeal with TennCare to pay these bills.

    Called back GKC,they agreed to postpone payment plan until appeal is over. Said if I fax them a copy of Certificate of Eligibility, (COE) they will delete said accounts. Called other CA (a$$holes), who said it didn't matter.

    Mailed dispute to EQ, CA that were uncooperative and TU. GreenCard shows TU signed for it 12/5/03.(?) Meanwhile I faxed copy of COE to GKC.

    Received letter from TU dated 12/8/03 (?) merely quoting the running period, and as mentioned in other threads, accusing me of using a CRO, and a form so they can assist me in filing a complaint against the CRO for misrepresentation. (Yeah, I fill out the form and then ALL disputes they get from that CRO will probably be marked Frivolous.)

    12/16/03, I called GKC, agent could only find 2 accounts, so asked her supervisor who said that they NO longer have any information on the one account that I sent COE for.

    I don't think TU investigated any of this, but how do I prove it? How can they verify if it's no longer there?

    I also disputed my personal information, because TU had my current address in VA, which has not been a valid address for over 9 years, my former address was my dad's OLD address where I've not lived for 15 years...long before I ever established credit. They didn't even address the issue of my personal information in the letter they sent me.

    Also, when all this started, I faxed a letter requesting and "itemized statement" from GKC. I received it in the mail and OMG, it had diagnosises listed...."Nausea, diar..." well you get the picture. (If not, I had the flu, so that should fill any any blanks.) Was listing my diagnosis, a violation of HIPAA? ---The visits were for a period from 8/99 - 2/01.

    The 30 days aren't up yet, but does anyone else see any violations by TU? And, can someone give me any advise about my next step? Do I write and tell them that I did NOT use a CRO, and that they have NOT addressed all the issues? Or say nothing, wait 31 days and send another letter?

    P.S. the ?'s by the dates are because I'm not certain those are the exact dates. I'm at my moms on her PC and my papers are at my house. Will check and repost with exact dates.

    Here are the correct and exact dates

    12/1/03 Mailed letter to TU
    12/2/03 Faxed Certificate of Eligibility to GKC
    12/5/03 TU signed green card
    12/10/03 letter dated from TU
    12/16/03 Called GKC, account deleted. Probably the day of, or day after they received my fax.)
