If anyone has encountered this CA, I'd like to hear your experience.

I owed a balance on a corporate credit card. The account was sourced to URS. After arriving at an appropriate balance (some of the debt was actually company business) I began making payments to URS. Interest on the account was 12% which I initially questioned. But they said that it was part of the original CC agreement.

About 8 payments into the account, I began to question whether the interest was appropriate. I contacted URS and asked them to show me where I was liable for interest. They himmed and hawed and said that such interest was "typical" on such collections (acct. originated in Colo.). I didn't relent, and demanded that they show me the document or the statute or that I wasn't going to pay the interest. Weeks later they finally conceded that they had no such docs or authority.

They're now trying rely on the original agreement where I unwittingly agreed to pay principal and interest. Moreover, I've already overpaid on the principal.

I sent them an ITS if they didn't return the overpayment. I'm thinking I'm gonna have to sue in small claims and prove that the interest wasn't warranted, but I'm wondering if my agreeing to it initially is going to be trouble for me.

    Any thoughts?

This CA is incredibly evil. They called me for the first time last month, and i told them i did not have a job and they agreed to call me in a month and see if i had a job.
Today they called me and asked why i did not make the $150 payment scheduled for March 9th. I never agreed to make any payments with these people. Besides the fact that i didnt have my first paycheck from my job yet on march 9th, $150 is a whole weeks pay for me!

I agreed to make a $50 payment on april 2nd. They tried to pressure me into giving them a post dated check. Uhm, yeah, after they pulled THAT one? I totally feel uncomfortable even giving these idiots a credit card number, routing number, or anything of that nature. I feel like i should just mail them some cash.

I have had serious problems with United Resource Systems Inc. They placed a false debt record on my credit report. When I wrote to them challenging this debt, I asked them to provide some evidence that the debt was mine. They could not. Instead, they place the exact same debt record on my report three more times AND did several unauthorized credit inquires. These action did serious damage to my credit.
Their unscrupulous practices have devastated my credit. I am still in the process of fighting these snakes.
For anyone who is having trouble with United Resource Systems Inc, I would recommend that you take the following actions.

    1. Read and learn the Fair Debt Collections Practices Act.

    2. File a dispute with the credit agencies (Experian, Equifax, TransUnion). Experian has an online dispute form.

    3. Contact the Colorado Board of Collections and file a complaint. They have an online complaint form.

    4. Contact The Consumer Protection Agency and file a complaint. They have an online complaint form.

    5. Contact the Colorado Better Business Bureau and file an online complaint.

Good Luck, together we can beat United Resource Systems and their evil practices.

You didn't ask them to prove that they had any evidence for the account at all? Dumb Bob wonders why you went for half a loaf.

Dumb Bob would like some clarification, so their legal argument is that they tricked you into an account stated?

You'll want to read case law in your state around this issue. You seem to have come to a solid agreement about what was owed including the interest rate. You then paid on that amount. The question is, what does that exactly mean in your state.

Dumb Bob, the original post was from 2003, so I'm sure you won't get any answers.

I'm not sure why people insist on bumping these old posts and trying to answer instead of starting a thread about their situation.

Dumb Bob didn't notice the date, although since people often seem not to listen to what is said, perhaps those reading but not posting will get something out of it anyway.

    That's a good idea!

Maybe they will, but so many people bump a post expecting the OP to answer when he or she is long gone.

Of course, Hedwig has been around here so long that she recognizes the names as being old. Not in age, of course, but long-ago posters.

United Resource Systems really is evil. Rather than sue them, I stopped paying them altogether; worked out a deal with the OC; and paid a reduced amount on the debt. The OC--which was a law firm--dropped United Resource and essentially dared them to make something of it.

I found an attorney who will work for free if you have any issues with United Resource Systems Inc. I am not sure how they make a profit but they did not charge me a dime to hear my case. His practice is in the areas of Fair Credit Reporting Act
