    Hi,
Can someone please tell me what the procedure is for getting an unlicensed CA to 'go away'? I have 4 CA's that aren't licensed in the State of AZ that have sent me collection notices and I would like to see what I can do about it. They are:
    The CBE Group, Inc.
    The Continental Alliance, Inc.
    Creditrust and
Peninsula Credit Bureau Commonwealth Information Services, Inc. (Can that name be ANY longer???)

I looked in the documents area here but I haven't see a letter for this exact thing (Although, I might have overlooked it.)...Does anyone know if there is indeed a letter and if yes, where it is?

BTW, a big THANKS to everyone for all the help and advice!! If I were 'in this' alone I would be terribly lost and confused! :)

    Easiest way:

If your state REQUIRES that they be licensed, turn them over to the state AG, then send a C&D. The only issue you would then have is their reporting on your bureau.

    Anyone have advice?

(Personally I would then do a dispute on these during CHOD).

How can a debt to an illegal enterprise even be reported.
Is such reporting legal in the consumer laws?

The enterprise don't legally exist so how can a debt to one legally exist either

Good question...can anyone explain the licensing situation in any depth? I called the AZ State Banking Commission and they confirmed that 2 of the original 4 I had suspected were indeed unlicensed. They wanted to see the bills I was sent by them, yet they wouldn't say what excatly the CA's would face in the way of trouble. (The other 2 were licensed under different names.)

You need to make a complaint to the state banking dep't. I complained to them about gulf state. They sent my complaint to them along with a "what are going to do about it" letter. It was deleted and the file closed in about 3 weeks.

in my state a license is $600 for 10 or more employees. but look at the bonding fee!!! don't think they want to pay that. it may be in the same range for your state. gather all of your documented proof of fcra & fdcpa violations you have on them (if any) and write them a firm letter. include a list of the violations. don't threaten to sue but do warn them that you have seeked "professional" advice regarding their misconduct. wait for a reply. if (or when) you get one, if it's anything other than a confirmation of removal, inform them that you will sue for the same amount of the required license fee. this should get their attention and warrant a removal from your files. this is based on the fact that they wouldn't want to be fined in addition to the licensing fee. btw, this is after you follow the recommended validation procedures and still come up empty. this strategy work for a friend of mine. p.s. only threaten to sue if you can, will, and plan to.
