    Im not sure so thats why Im asking.

    For some reason for the past few months Im getting letters about old debts ive had. Yesterday I get a fancy looking letter from a law office. They say they are collecting for an old debt I had with fingerhut.

    They flat out tell a lie in the letter. They say that they have already reported the debt as delinquent on my credit report. That is a lie. Its not showing up on EQ,Ex, or transunion.

    Then they go on to say in bold letters if I pay the bill they will update the reporting to paid in full with a zero balance.

    Im not real up on the collection or reporting act but it seems like there is a provision about using deception to collect a debt.

    I know the SOL has passed so Im really not concerned but it ticks me off for them to try and trick someone into paying a bill. I know I havent heard jack from fingerhut in close to 4 1/2 yrs or so. I never got any collection letters from fingerhut or anyone. Until I got this letter yesterday I had forgot all about this.

    Seems like ever since Ive started trying to clean up my credit the old account are coming out of the blue. Its been like hitting a beehive with a bat

    Do you want to sue? You could probably get 2k easy for violations of the FDCPA and the Uniform Deceptive trade and practices act.

    If I knew I had a slam dunk case I would . no one in thier right mind would turn down 2k.

    Im just not sure of the procedure to bring a suit

    What have they done wrong? Maybe they're in the process of doing it and you got the letter first. Maybe the CRA's are slow this week...

    If they haven't reported to the cra's - that's bad? Take it as an opportunity to head 'em off at the pass and negotiate for no posting.

    I've had a couple like that pop up. Someone here mentioned a feature called skip-tracing where the CRA reports activity on an account to those who subscribe to the service.
