Wachovia Recovery (bank account) that was charged off but I paid the balance because I needed to open a new account in January. I have disputed it with all 3 several times, each time comes back that the information is correct. I sent a goodwill letter to Wachovia and got a letter back from them saying that they do not remove accurate information. Any ideas??? When you disputed, did you request the CRA's send you procedure information? The FCRA, Section 611 (a)(6)(B) requires them to send you a bunch of information within 5 days of the conclusion of the investigation, including a notice that you have a right to get a description of their procedures. This description must be sent to you within 15 days of your request. If they fail to send you the complete five-day notice, this is a violation. If they fail to completely respond to the procedures request within the 15 days, this is a violation, per subsection (7). That response includes: I would ask for dates of contact as well. If the CRAs violate these provisions, they could be on the hook for $1,000 plus punitive damages and attorney's fees for willful noncompliance, or actual damages plus attorney's fees for negligent noncompliance. (Sect. 616 and 617 of the Act).
I have only disputed online and on the phone with the CRA's. I have not sent in any letters yet regarding this item. Can you steer me to a letter that may already have been written about something similar to this because I am really not a good letter writer. I have found great goodwill letters, one which I have used to send directly to Wachovia, but any help would really really be appreciated.
