Can two ca collect for the same oc?

    I have received two collection notices for the same account number one is from capital management services the other is from Account solutions group.Their both telling me that my past due account with washington mutual has been assigned to them for collection purposes. Is this legal?Can a credit card company send your account to more than one collection company? I received the letter from capital management on nov30 2006 and one from account solutions group on dec 27 2006 both list the same account number.

    Yes they can. I've even heard of creditors sending the same account to as many as 5 debt collectors at the same time in order to see which one is the best at collecting then start using the most successful almost exclusively.

    Sort of like opening the boxes at a greyhound race track to see which one catches the rabbit.

    Cap1, not at the EXACT same time.

    The account would have to be recalled to the OC, then re-referred to another CA.

    A simple reason, if more than one CA is collecting at the same time, it would cause confusion as to whom the consumer has to contact to exercise their debt validation rights, ergo over-shadowing the validation notice.

    But, when I get over-lapping dunning notices, I use the following advice...

    (bad movie quote paraphrase) dispute them all and let their lawyer's sort it out. :)

    And, yes... I actually dispute all of them on the same letter.

    Not at the same time?

    I saw that on a message forum and am only quoting what I have seen on another message board frequented by lender employees and bankers. I don't remember how long ago I saw the posts so it might easily have been a couple of years or more ago.

    I have no personal knowledge on the matter.

    No problem, but do you see the problem that overlapping CA's would cause.

    It's getting close enough when the account hits multiple CA's within the 30 day notice (because do you send to CA1, or CA2, or CA3 - my answer all of the above :))

    But, I just love sending dozens of CMRRR's at one time... :)

    Yes, I do see the problem.

    I do see the problem but do you imagine that the creditor who might do that really cares? Not likely. His sole interest would be to see which collector turned out to be the best collector. Creditors care not what unintended results might arise from their actions.

    I tend to think you used the wrong smiley. Which did you intend to use,

    If I had to send out multiple demands for validation at $5 a copy I'd be using :(

    Nah, think of the $5 as an investment... :)
