cap1sucks, I am kinda new here and I have read through all of the information I can find. I have an old cap1 card that was a charge off because they stopped sending me statements. They keep reaging the account and it shows as a charge off as of Jan 2007. I sent them a validation letter but didn't include my social. When you send validation letters do you need to include your social? Also, what is the typical response from them and where do I go form there? Thank you.
No, you should not send them your social. One way to identify yourself and the account you are disputing is to include a photocopy of a letter they sent you, preferably the first one and with a date less than 30 days from the time you received it. There isn't any typical response. They might not even respond. There is no requirement in FDCPA that they must reply at all. The only requirement is that they must not engage in continued collection activity until they do validate. If they violate that your only recourse is to sue them.
Have you sued then in the past and what was the outcome? They keep reporting a new balance every month and it is a lesser amount than before but I'm not paying it off and they have never contacted me? Thank you
