This is my first post so please bear with me. I just started my journey recently in repairing my credit and I am excited yet so very confused. I have a CO on my credit report that I disputed. When I disputed it through it had a bunch of information including lates and finally the CO that dates back to 2/05. It says that unpaid balance reported as a loss. This untrue as I had paid back the debt that I owed. So they not only verified that the information was verified but they removed all other information and now it only showing 2 years with CO and now it will not be removed from my cr until 2011. I have the cancelled check that I paid them. What should I do. I would really like to see if I could have this removed. Should I send the company a letter? Please advise. Thanks
Seems to me that when you paid them you admitted that you owed the debt. From what you have said it seems to me that they may be reporting correctly or reasonably so. That don't mean you can't dispute it as often as you like anyway.
If it was paid, there has to be a notation within the tradeline as such. If not, that is incomplete reporting and if they verified the accuracy of the tradeline absent said notation, that is a FCRA violation. With that in mind, I'd dispute it one more time pinpointing the lack of notation and inaccurate status fields and perhaps, the date of last activity/date of first major delinquency (if any is present and if not, the omission). If they verify again, consider retaining a consumer attorney (on contingency) and instituting a civil action against the furnisher and the credit reporting agency wherein reported. Make certain you have some fashion of damage before doing so.
