I have an old charge off listed on my Exp & Equifax reports that I disputed 2 weeks ago because it is not a charge off. I filed a Chapter 7 in 2002 and this debt was included. It has been reportly incorrectly for nearly 5 years. I received a letter from the OC today (Chase) saying they had received my dispute and they included a form with two options: Affirmation of Fact: to fill out if the account was fradulent. Affirmation Acceptance of Liability: to fill out if account is mine and I am liable. They also included a copy of the original BT when the acct was opened. It is appearing to me that they may not have received the BK paperwork. Neither form option applies to me because the debt was included in a Chapter 7. Experian has already deleted the TL. It still appears on Equifax. What is my best course of action? I tried to call the 1-800 number to speak to someone, after being on hold for 15 minutes they transfer me to Account recoveries which is closed. I am afraid to sit on this because I fear they will: reinsert the account and/or reage the account Should I try to call back in the am? or send a letter? Do I send a copy of my BK notice? Call them. Send them a copy of the banko papers. If you disputed properly on the CRA it would have an option was included in banko.
Finally got ahold of Chase today after being on hold for years and transferred to 3 different departments. They said they will update it to IIB. They never received the bk papers....uggggh. I was hopeful they would delete it but IIB with a zero balance is better than a charge off that looks like a unresolved debt. At least they didn't verify it first like the others I have disputed. Problem is my report is full of accounts just like this. Luckily they will fall off after a painful death in about 2009. 7 years I beleive? But I need them correct now since I want to try for a mortgage at the end of this year. Good news is I am clean otherwise. No post bk debts biting me in the arse except two that I paid off 3 years ago and are still reporting incorrectly. I have disputed those too. My advise for anyone who has had to file a bk is to check that those accounts were notified and are reporting correctly. Don't apply for a mortgage like I did only to be declined because you have too many chargeoffs. Doesn't matter if they are incorrect, they are there and will continue to be there until they fall off or you correct them. Don't just think they will report as they should because most likely, they won't. It's frustrating.
