Friends new cell phone gets calls constantly

    Obviously when he tells them that he is not the person they are looking for they don't believe him. He gets about 3-5 calls a week like this.

    You can't send them a CD because they wouldn't have your name on file, or do you include the persons name they are trying to reach with an explanation?

    Send them a C&D with his name/address/phone number and advise that it is a new number and there is no such person at the number they are dialing. Send it CMRR, or fax it.

    You are not telling them to C&D calling the person they want to reach. You are telling them to C&D calling YOU. They are a debt collector and you are a consumer under the law, and to comply with FDCPA, they must C&D communications when requested.

    Although it might be helpful if you can provide the name of the person they claim they are trying to reach if you can do that, there are circumstances where they might either not disclose that, or their autodialer might never even connect the consumer to anyone.

    If they are repeatedly calling your number, they better have a way to stop calling it, or they will not be able to comply with the law.

    Somehow, if you have to sue them, "We don't know how to stop calling him." doesn't sound like a good defense.
