Hello everyone. I have been reading this forum for awhile and have accomplished a lot of repair using what I have learned here. I have a couple of problem creditors which I would greatly appreciate input about. On my TU report, there is a HSBC chargeoff from 2004. This is reported by HSBC and also by Main Street (a collection agency). I have disputed the account through TU and it was "verified" by both of them. I also sent a DV letter to Main Street over a month ago and got nothing back. I have a similar problem with Asset Acceptance. A $65 account, charged off in 2002 which they "verified" on dispute. I also sent them the DV letter and got some BS back which was just a line from their internal records. No proof of the account, etc. Is there any further step I can take to remove these items? What is the basis of the dispute, are the accounts yours? CA are not required to respond within 30 days to a dispute. They simply must notify the CRA that you are disputing the account and cease collections until the dispute has been verified. What ''proof'' did you ask for the in DV letter? Was it sent within their 30 day notice?
I asked for the standard proof that is in the sample letters but I didn't get anything back from Main Street and only an internally generated entry from Asset Acceptance. Thanks.
Are you aware if Main Street even received your notice? Was it sent cert. mail? If they have received it, they could be investigating it still, again they are not required to notify you within 30 days of receiving your letter. What exactly does the letter from AA say?
In what order, and timeframe, did you do these actions of DV letters and disputes with the credit reporting agencies? What reason did you give for disputing the tradelines with the CRAs? The general technique is to request the validation first (sending Certified Mail Return Receipt Requested). Then disputing with the credit reporting agencies AFTER you receive the "green card" back from the CA. If you disputed the accounts with the CRAs first, and they verified, THEN you requested validation, this weakens the approach. As Collectman said, they do not have to send validation after the 30 day period, and there is no violation for the initial "verification" with the CRAs.
Make it simple: OPT OUT Delete any and all old personal information from any CR which has negatives (old addresses, name misspellings, phone numbers) Dispute the accounts as " inaccurate " by writing a simple dispute letter to each CRA.
