Validation/Please Advise Is a rental application for an apartment considered "validation"? Should the CA provide the original signed lease as validation? Also, if the CA writes you and tells you "this is a true and valid debt and our client has enlisted our help in recovering their loss", is this proof that they were actually contracted to collect for the original creditors? Is a computer printout of different fees considered validation of a debt?
The CA has to obtain validation from the original creditor. A printout of their's won't cut it. Also, an application is just that, it isn't a contract.
In the end, "full and proper validation" is what the judge you're in front of considers it to be. This is a wide open topic, and it has come down to courts somewhat saying "we'll know it when we see it". In your case, it would seem they should be providing the original lease/rental agreement. In your post, the CA's language is referring (in part) that they have the full legal right to collect the debt. You should go back at them requesting (again) full validation evidencing your legal obligation to pay, and exactly how the alleged owed amount has been calculated. The (above) "judge" will ask for this.
