SOL ? filed or served

    Someone attempeted to serve a summons to me yesterday but was unsuccessful. A message was left to call him or her. I looked on my county's civil court website and found a case that was filed in february of 2005 for a debt that the sol was up in february 2005. I have never been served before but it still appeas that activity is occuring on this filing per the website. I would like to know if the SOL counts when the case is filed or when you are served?

    I have also sent a DV to this company in 2004 and they sent me a notarized affadavit of debt that had the alleged account number, amount owed and who the account was purchased from. They also quoted the Chaudhry vs Gallerizzo case. I never follwed up to that letter. They never provided me with proof that I owed a certain amount or that I owed them for that matter.

    It was no longer on my credit report last time I checked(it has been past 7 years). I am not sure how they found me at my new address, but I am going to have my credit reports checked today. I was thinking I could go the SOL way, but it looks like they filed right within the sol period about 20 days.

    Please help!

    The SOL counts until filing of suit, it is not when served or court date. Looks like they made it under the SOL.
