My mother filled bankruptcy about 10 years ago. Instead of going through with it she got another job paid off everything on her own. She has very good credit otherwise but recently she went to refinance her car loan but was denied due to the bankruptcy. Is there a way to get this removed as she never actually went through the bankruptcy proceedings ..all she did was file and then cancel it. She did the right thing and its screwing her now ...is there any way to fix this.
10 years from the date of filing the bankruptcy it will be removed. Since she filed it and voluntarily dismissed the bankruptcy, it will still show dismissed for 10 years.
It actually never said dismissed ..its just there on here credit report ..she never went to court or anything ..just paid a lawyer and then a week later told him she did not want to go through with it ...
She should contact that lawyer and ask him/her what exactly he/she did - if he/she remembers, and have him/her repudiate the information listed on the credit report.
Check the local court records for the filing also, to verify it is not there, or was never filed. You would want this "evidence" in case you dispute with the credit reporting agencies, and they return the investigation results as "verified".
