Hi, I am a newbie, but I have been reading this forum for over 2 weeks daily. I also bought a book called the Credit Secrets Bible. In it, the author says that Collection agencies don't have the legal "right" to collect a debt from me. It goes on to say that I should write a letter to each collection agency saying something like this. " Show me evidence we have a written relationship that obligates me to do business with you. If you can't, get off my credit report and don't contact me again." It says "What written agreement, law, or statute gives them the authority to force anyone to do anything?" It says that the CA has to be able to produce a contract from the OC that names them as havign the authority to collect on the account. I am asking the gurus here to tell me if this is baloney, or if it is legit. I made the *STUPID* mistake of paying off debts a month ago before I learned about PFD. So, now I want them off my report, and it seems like this may be a step, and if not I will use the nutcase. Any suggestions? THANKS!! Mandiemo
One more question... I am ready to begin (after LOTS of reading)... I have 5 Collection Accounts that I paid off about a month ago (some in full, some settlement- all 3+ yrs old). I did that stupidly before I found this site. I now want the TL's deleted from my file- or at least to say "paid as agreed" not "settlement" or "paid charge off" as they do now. Do I go nutcase on all of them (all CA's), or is there some other letter I haven't found yet that is more appropriate for my situation. I GREATLY appreciate ANY feedback. Thank you!! Mandiemo
Looks like you wasted money on that book. A CA has an affidavit of sale from the broker/OC they bought the account from, they are not required to provide that to you. If you ask for it, they may or may not send it to you.
But to establish their legal right to collect they better produce it in Court. Otherwise I could sue every CA in town alleging that I bought a debt of theirs, whether I did or not and whether I have standing to sue or not.
