Credit Report Verification Question

    recently I disputed two items with the following result. I have a paid charge off to see what happened. They verified, but what they verified is not correct. They verified as being 120 days late in Dec 06 but I paid it off in March 2005. So I sent a verification letter a month ago Certified mail with no response and I just sent another with a 15 day response time frame. MY QUESTION IS THIS WHat should be my next step? Its MIDLAND CREDIT MANAGEMENT in San Diego.

    You can ask for a "reinvestigation" of the dispute, citing the incorrect information resulting from the verification. Be prepared to be asked for documentation of your claim from the CRAs.

    You may want to dispute with the CRAs again, in writing, disputing this exact data field.

    Midland Credit Management is a rather fickle beast. It helps to know how to dispute the tradeline by data field; i.e., account type, status, incomplete fields, etc. It also helps to know someone within Encore.

    It should never have been reported as 120 days late as Midland is a CA. Are you looking at straight from the CRA's credit reports?

    Yes. To make along story short, I disputed all 3 CRA's electronically to see what would happen. They came back verified but on my old reports this account had varying amounts and dates. Now they changed it but it's still wrong i.e. 120 days late DEC 06 when I have proof I paid in March 05. I wold appreciate any advice in this matter as I have sent 2 crrr letters with no response. I am just not sure how to respond next. To make it worse the original creditor, HSBC NV was evidentally sold so after going through several hours of inquiry I sent out dispute letters to them as well. Not really sure what course of action to pursue to remove these 2 accounts as they are the only derogatory remarks on my report. I am Graduating college in may and I want to get a good job and I know this can be a hinderance.

    Also I have a HSBC account now that is current and never been late. Does that give me any leverage with HSBC?

    I HAVE LEARNED ALOT FROM THIS SITE BUT I AM NOT SURE WHAT AVENUE TO PURSUE TO REMOVE THIS. THANKS AGAIN FOR TAKING TIME TO HELP ME OUT AS I ACKNOWLEDGE THE SENIOR MEMBERS ON THIS SITE HAVE NEVER STEERED ME WRONG. THANKS

    As Jlynn stated, you need to dispute the account status; i.e., they cannot report a 120 day late insofar as debt collectors do not extend credit in which repayment can be late. Secondly, the cannot report an "open" or "installment" account type. Third, they're not a date factoring company.

    This will give you some footing but, remember, this is Encore. They couldn't care less about the FDCPA and the FCRA. It may come down to finding the right person in San Diego or at their corporate counsel's office in Mississippi.

    HSBC wasn't sold, they don't hold their paper - your account was sold to Midland probably rather quickly after it was charged off. Your new account with them won't give you any leverage, as they have no ownership status.

    You need to redispute via a letter (not electronically), and be precise in what you are disputing.

    UNLV,

    If possible, could you post exactly how the tradelines appear on your credit reports? DO NOT POST PERSONAL INFO. It would be helpful to see exactly how it is reported, then add pertinent information that you know (i.e. your payment dates, etc.).

    If you've paid this debt, Midland will not bother with you at all, so do not expect any kind of response.

    The reports I printed on 9/23 were way different in that they had the amounts charged off dates etc... but on the new reports the amounts i.e. charge off date, amount,date maj delinquency reported are all blank. Also they charged this off the month after it was 30 days, can they do this? Another question, on my TU report after date paid it says 3/2004 and date closed 6/2004 isn't that incorrect as well or is date paid the last payment date? I missed the May payment and the next month it was charged off. I appreciate everyones help as I am not a deadbeat but made an error in judgement early in school. Now my scores @635 but I want to get everything straightened out. Once agai thanks.

    Blanks are "incomplete reporting" and can be disputed as such. Demand they report everything or delete.
    I'm not sure what you are saying, but Midland can't charge off anything. Its a bad debt.
    You posted Midland's entry, but are you talking about Household's entry on your report now?

    I agree w/jlynn's comments. But, just to clarify, are you certian this is listed under Midland? Is this account listed under the "Negative Items" area of your credit report? It should be under a category of "Collection Accounts".

    Just want to make sure we're not confusing the original HSBC acct/ w/the Midland account.

    OP said this was a TU report, which doesn't have a separate category for collection accounts. They are all mingled.

    EQ is the one with the separate category, with separate info required. Midland tends to report in such a manner, that they avoid this category.

    It fairly easy to remove this Midland entry if you do as suggested herein.

    As for HSBC, it will stay absent litigation. They will mark it as being in dispute however, and this will not be scored by virtue of that.

    I'd like to know how the HSBC TL is reporting. It should report as sold or transferred -0- balance.

    Ok. I subscribed to the Transunion True Credit report service and there are 2 entries for the Midland Account. One that has a TU an Experian entry and another seperate entry for equifax.

    IM GONNA USE CAPS TO DIFFERENTIATE BETWEEN THE ENTRIES AND MY COMMENTS. THANKS FOR EVERYONES WORLDLY ADVICE.

    ON THE HSBC ENTRY SHOULDNT IT SAY THAT THERE WAS A LATE PAYMENT BUT IT SHOWS NONE. ISN'T THAT INACCURATE AS WELL. I SENT THEM LETTERS BUT NO RESPONSE FROM HSBC OTHER THAN IT WAS SOLD TO SOMEONE ELSE AND IT WAS AN ORCHARD ACCOUNT AND FURTHER INQUIRIES SHOULD BE WRITENN TO AN ADDRESS IN OREGON. SO I DID THAT TWICE WITH NO RESPONSE.

    I figured it was Midland and EQ reporting the 120 late status. If you pull a report straight from EQ you will have many more items (such as they are likely reporting as a factoring company)

    This is a collection account they are reporting as a factoring account in an effort to mislead the consumer. To have full and accurate disclosure a collection account must report the Original Creditor (they don't -ignore the acct number you are a consumer), the Date of First Delinquency, the date of Last Activity, a Creditor Classification, etc. A collection cannot be 120 days past due - this is an effort to further damage your credit rating, and the list would go on.

    What should I do to remove this?

    Should I cancel the current account I have with HSBC now so they can't pull my reports?

    Write more letters, or call. HSBC sent me a letter that didn't verify it just said the account in question was a Household Orchard account that was purchased by another lender. They list an address and a telephone and Reference Number. I sent 2 letters certified to that address in Portland but they never responded.

    Whats strange is that I pulled my Equifax Account today from their website and it is still listed as an open account MIDLAND that is. Any suggestions. I have already sent my second certified letter to verify a week ago with the 15 day deadline. Whats next? Also on my Equifax report it has the HSBC account listed as date closed 6/2004 but under that it has date paid as 3/2004. Isn't that incorrect as well.
