Settlement? More on Unifund (they suck)

    I have some old bad debt on my credit report (which I pulled today).

    My score is 553 (I had some inquiries which dragged it down some within the last few weeks).

    Interestingly enough, Unifund is not listed as a creditor on my report. They are listed as having pulled my report, but they don't have an account on the report NOR is the old Citi account on there. Is this because the SOL in the state of Tx is 4 years?

    I called Unifund today. As expected, they expect me to "work" with them through their lawyer.

    Did moving to NJ screw me over? The account isn't there...

    So in the event that I have to end up paying them (after filing my answer, going to court, etc), I would still like to take care of all the other monkey business on my report.

    What is the best way of going about this? Is there anyone out there that will give me a loan?

    Stats:
    25 yo
    553 - Experian score
    Gross Inc: around $44K
    Total Revolving debt: $6K

    Will paying off the delinquent accounts raise my score at all?

    No, reporting is voluntary, and it has nothing to do with the SOL for collecting a debt successfully in a court.

    That's a good question, as they may be getting ready to report. Sometimes agencies wait out the "30 day dispute window" before reporting. If you've recently received the letters in the mail, then reporting could be close behind.

    I saw your other posts and you are doing a great job! I wish you much luck in getting this resolved.

    I have a rather basic question & pardon me if you already know this. Have you gotton a copy of all 3 of your credit reports? I just see references to Experian, have you seen Transunion & Equifax? I was just curious as alot of debts will sometimes just report to one, or all 3.

    Also is the 533 score for Experian an actual FICO score? or a Fako score? sometimes there is quite a difference between the two. Actual FICO's are the "real" score whereas Fakos are usually estimates.

    If you have'nt I would encourage you to look at all 3 so you have a better overall picture.

    And again I apologize if all this is old news.

    Good point which I missed. Always get the hard-copy reports from each bureau before starting your repair. The online reports consolidate things and don't show the true reporting from each bureau.

    Ok - so I'm back. I have a week to get this (my answer) to the court and plaintiff's attorney.

    Thank you everyone for your help thus far, especially Enigma who presented me with a draft answer to use --

    My question has to do with the last two bullets of the draft for my affirmative defenses:
    ------------------------------------------------------------------
    2 . Pursuant to Rule XXXX XX Rules of Civil Procedure, Plaintiff failed to attach notes, bills of exchange, account statements, contracts, or other documents upon which an action may be brought.

    3. Pursuant to Rule xxxx xxx Rules of Civil Procedure, the statute of Limitations has lapsed. This needs to be cleaned up for your local rules.

    I'm not able to find clear (at least for my layperson self) Rules of Civil Procedure that state numbers 2 & 3 for NJ. Also - the statute of limitations had lapsed already by the time I moved to NJ (the SOL expired in TX) - how would I word that?
