Hi and thanks to all of you for what you do here. I had a collection show up on all three about 6 months ago. Listed as Medical Collection Associates for a $500 medical center debt from 2005. I know that this is not mine, since I have never been to a hospital or any medical center for at least 10 years and it is in a state about 2000 miles away from where I live. I disputed twice with all three credit bureau's and all came back verified. I sent a validation request to the agency and they responded with a print out from the medical center, with my correct name, no social security number, a different date of birth and a different address that I have no knowledge of. The letter states that "This debt validation statement fulfills the requirements of the FDCPA and the FCRA. You must pay this bill now to avoid further action." It also states that "This itemized statement has been provided by our client, your creditor." Who should I proceed with; the collection agency or the medical center? Any suggestions as to the next course of action. All your help is sincerely appreciated.
This issue can be dealt with, but there will be a "PITA" factor (Pain In The A**). You should reply to the collection agency in writing, that this is not your debt, as the "evidence" provided shows this was not your address, and the lack of a SS# provides further doubt. Be sure to send this reply Certified Mail Return Receipt Requested for your own protection. Next, take the initative to contact the medical provider, explain the situation and request their evidence that they have the correct party. Should the mix up be cleared, make sure you get something in writing stating this. You may need this to provide the credit reporting agencies should this not be deleted from your credit reports. This is a clear case of what the Fair Debt Collections Practices Act is all about, ensuring that the correct person is contacted. So, prepare yourself to pursue legal action should you not get results through normal channels. Good Luck.
