re-inserted

    Hello all, here is my problem I disputed some things with Equifax about 3 months ago. They removed a collection that is honestly not mine, and then about a month they re-inserted it on my report. I still have the investigation results where they said it was removed. They have never sent me anything in the mail saying they were going to put this collection back on my report. I guess my question is what should I do? Does anyone have a letter they can give me a link to that I can send out? Or should I just call and give Equifax a piece of my mind?

    They removed it when you first disputed it. They have to. Then they contacted the outfit that had it listed in the first place. They obvioulsy put it back on. It's a cat & mouse game.
    Dispute it (the debt) with the collection goons as not yours and demand a validation.

    Insofar as the account tradeline was deleted by virtue of your request for re-investigation, the credit reporting agency must provide you notice of re-insertion within five days of said re-insertion pursuant to the FCRA. They are in violation of the Act now and you could sue them for it. However, Equifax is pretty fair about removing these issues when you bring it to their attention. A call or written communication should once again remove it.

    But then it really becomes a cat & mouse game. Equifax removes the tradeline, but has to notify the creditor or CA. They turn around and have it re-inserted.
    As far as the CRA having to notify you if the CA re-inserts something, filing a suit against the CRA for not notifying you is an exercise in futility, months maybe years.

    No, it's not removed when you dispute. It's marked as being in dispute.

    If the creditor doesn't verify, it is removed at that point. Then, if they later reinsert it after removal, they have to notify you within five days, as Apex pointed out.

    You usually just have to call Equifax and they take care of it in these circumstances. Not a really big deal as Hedwig and myself suggest.
