   Can capital one be the plaintiff in a lawsuit against me if in my credit report it shows capital one reporting the account as a charge off and write off?

   Yes, they would be the plaintiff. Just because a debt is "charged off" does not mean it is eliminated. Cap1 can still attempt to collect on the debt.
