Hi guys, I need advice on how to handle this. As I know that you will be able to give me advice on how to handle this. I currently live in the state of FL but this account was opened in NY. Should I send a DV, C&D, SOL letter or what? I can't believe they are coming after me for this. This doesn't even show up on my credit report. The last one that I pulled was back in 3/2006 but own a home and just refinanced back in Aug. Is this why they are trying to collect on this debt? Name of Original/Previous Creditor: Citibank Original/Previous Creditor's Account # XXXXXXXXXXXX Date Account Opened: September 1, 1989 Social Security Number: 0**-**-**** Last Payment Date: February 5, 1992 RJM takes seriously its duty to maintain accurate information. I would send them a length of rope they could go piss up, or some of the lovely white Florida beach sand they could pound. Seriously, a cease and desist letter would be appropriate. Just remember, in Florida any renewed promise to pay (in writing) will reset the SOL.
These jokers just sent me a similar letter for a debt that is about the same age. I sent them an SOL letter that also disputes the debt. It is a form letter from the internet, but it works. Here is the link: http://www.debt-n-credit-letters.com/Debt-Dispute/SoL-dispute-letter.html You could also check to see if they are licensed to operate in Florida.(Don't know what the requirements are in Florida) I live in Texas, and they have not posted the required bond with the Sec of State in TX to operate. I also filed a complaint with the TX AG and the FTC and sent copies of the complaints with my SOL letter.
Since they have in fact admitted that they just bought this "debt", this must be their first letter. Where is their FDCPA required notification of your rights to dispute or request validation of the debt? Did they say they were a debt collector, and that any information provided would be used to collect a debt?

Yes, the letter states that this communication is from a debt collector and that any info provided would be used to collect a debt. I sent them a SOL letter via Certified Reg Mail Ret Rcpt this morning.

Send the Letter Girlfriend I have not heard a thing from RJM after sending the letter and it's been over a year now. I would send the letter and hopefully you wont hear anything from them ever again. Success in Calif Just HAD to tell you how grateful i am to dch8ter for posting the link to debt-n-credit-letters.com for that form letter. i was being harassed by RJM and a couple of other companies, but after i sent them the letter, they stopped bugging me. my credit report has been clean for a while and i just bought a house! It only cost me a couple of stamps and saved me a lot of anxiety. THANK YOU!
