I am in the process of cleaning up my credit report. I have two negative on there and one is with Citicard. The nasty buggers have served me with a summons and I sent my answer Wednesday. My question is, should I just throw in the towel and make an offer of a settlement directly with Citi or the collection agency posing as lawyer's? The CA/lawyer's are Weltman, Weinberg & Reis. I sent the DV letter and all I got for my trouble is copies of statements with my name on them. I was paying on the account and I was late and of course the interest went up and so did the fees. I paid what I could and it never was enough. It is not past SOL so that is why I am asking. I want to take care of this, I just don't know the right way to do it. Also, can they get a judgement even though I have filed the answer with the court? Should I now send them interrogatories and discovery questions? I want to pay, but I want them to work for it. I have been reading every thing I can for the last 2 weeks and I a realize I am not alone. I just want this behind me and should have never let it get this far.
They can get a judgement if you lose the case and or you default and do not go to court. Citi is a hard won to win if they are still the OC as they will have all the paperwork needed to show that you owe this debt. I believe you will be able to pay no more than 50 percent to get this a done deal as IME this is what they will take. Of course this is onl y if OC still owns the debt, if it has been sold, then I would go to court and see what happens, as you will have severalmonths at least to figure out your options IF you keep plugging away at the paperwork. If you want to settle with a JDB think NO MORE THAN 25 PERCENT MAX!!! MORE LIKE TEN PERCENT!! Woofer Woofer
How do I know for sure if the account is still owned by Citi? It shows as a chargeoff on my CR and a zero balance.
Hmmmm then this could mean that they sold the account.Usually Citi doesn't. This would be GOOD for you if they did : ) Does it say CO on all three CR? Any tradeline from another JDB? Woofer
This card with this number doesn't even show up on my credit report! I just don't know what the best thing to do is.
