Hey, I'm a 20 year old student whos biggest problem should be no credit, instead of bad credt. Here's my story: In 2004 (I was 16) I got an MRI done and my mothers insurance covered most and my mother paid the rest. Well I look on my credit report and this company is still negatively reporting on my credit. I have even spoken to a representative at this company explained that I was too young to be held responsible for this debt and still nothing has been done. If anyone could please ive some advice on what I need to do to get this account off my report please let me know. And I have already disputed it on the credit reporting agency. HELP!!!!
NCO is one of the greatest companies in the world, considering that they've gone into history as being the LARGEST FCRA SETTLEMENT IN FEDERAL TRADE COMMISSION HISTORY. Send a letter telling them that they have 10 days to delete this account, or you will sue them for violating the FCRA, and report them to the FTC for violating their settlement for willfully and knowingly reporting false credit information. A day or two, after sending the written dispute to NCO, send a written dispute to all the consumer reporting agencies disputing the debt. NOT MY RESPONSIBILITY-MINOR AT TIME THAT THIS MEDICAL BILL WAS INCURRED, NOT RESPONSIBLE PARTY. Send the letter to NCO Group at Tracey A. If NCO verifies the account with any of the consumer reporting agencies, file a suit against them citing Johnson v. MBNA. You mailed them a SPECIFIC DISPUTE, they VERIFIED the SPECIFIC DISPUTE with incorrect information. You'll want to obtain a local attorney if you don't want to file on your own. Make sure you have copies of the NCO-MEDCLR dispute; and CMRRR; the CRA dispute, and CMRRRs for them; and the CRA Investigation Results which will be mailed at the conclusion of the investigation. If they verify, you'll have them for reporting false credit information under the FDCPA, and failing to properly investigate a dispute under the FCRA. $1,000 for the FDCPA violation (you already should be able to have them on this, but it'll be cemented further once you dispute it as not being the responsible party), $1,000 for EACH CRA which they verify... you were a minor it should not be on your credit report.you need to contact the cra and dispute as not mine send it cmrrr.as for the company send them a letter demand that they delete this information from all 3 credit agencys
This is all you need to do is use the verbiage Jam mentions (you will sue them), and they will delete it off your reports. It should take about 2 weeks for it to disappear.
BTW: As Jlynn pointed out, I used the verbiage exactly as I did for a reason... Johnson v. MBNA. The MBNA account was Ms. Johnson's ex-husband's account, at most she was added as an authorized user, but when her ex filed for BK, MBNA decided to take his name off of the account, and try to claim that the entire account was Ms. Johnson's, despite not having her SSN, or DOB. Ms. Johnson's CRA dispute was that the account was not her's but her ex-husband's account. MBNA verified the account as hers, but was found to have violated the FCRA, because they only performed a cursory investigation of their computer records; and not a complete investigation which was thorough enough to discern whether or not the account was her ex-husband's account. Had MBNA performed a reasonable investigation, and noticed that they had neither Ms. Johnson's SSN or DOB, they SHOULD have realized that there was no way for them to have opened an account in her name, without having her SSN, or DOB. As jlynn pointed out, you probably will have to file, but hey, you can always use $4,000 x-mas in July money...
