A Collection Agency is filing a Judgement against me on behalf of a surgeon concerning a shattered elbow in a fall. The amount is over $6,000 I have 1099 income. I need to know if they can get a garnishment if I am not an employee. It is my belief that they can get into my bank account. If they take money once, can they repeat whenever they want? I have a 1996 Jeep Cherokee which I don't think is in danger. Am I correct? I tried to work out a payment plan, but was told that the payment would have to be $500 - $600 month which I can't afford. Agent very unresponsive and wouldn't even return my calls at first. Is there anything I can do at this point to protect what I have? I am willing to make reasonable payments, but I lost everything in the accident and don't want that repeated.
They can't get a judgement, without due process have you been served with a summons'.have you dispued this with the ca.I would keep very little money in the bank, time for the coffee can bank.do not panic threre are people here to help you out listen to them.and then you can make your own choices.
Judgement Yes, I was served yesterday. I don't know what to do to respond to the CA. Thanks for the help.
How old is this what state are you in and have you made payments to the doctor.you could try to work out a payment plan you know what you can afford.antway if it goes to court you have show up.
Judgement The surgeon bill is from 2003 and I have not paid any payments. I couldn't work for a year, and I'm just getting on my feet. The state is Colorado. Can I try to arrange for payment with the doctor or the attorney, because the Collection Agency will only accept payments of $500 - $600/month which I cannot do. Can they garnish my 1099 income?
First i believe they can only take 25% of your income, the ca is playing games trying to bully you into paying that you can bargain i'd start at 75 dollars or what you think you can afford but stand up to them don't let them bully you.if they had waited 1 more year they would't have been able to collect sol would would have kicked in.DO NOT BE BULLIED YOU HAVE YOUR RIGHTS.
judgement I told them I could pay $100/month and that's when she told me they would accept no less than $500. I said I couldn't pay that, and she said 'see you in Court'. I was served 3 days later. Can I still try to arrange payments with anyone else? The lawyer? The girl at the Collection Agency is impossible to work with.
Have you tried putting this in the Credit Talk forum? Maybe you will get more response there. Good Luck. Wish I could help but I have no clue.
