Mann Bracken / Midland Funding

    Looking for advice!! Please help. Just received in the mail today a collection letter from Mann Bracken representing Midland Funding. It was sent to my previous address & forwarded by the postoffice. I have been researching on line for hours & I'm more confused than when I started.

    Basically Midland purchased an old debt from Household Finance in May 2008. I am in GA now, but the loan was obtained in Alabama in 2001 and I made the last payment in Jan. 2004.

    As a side note, I was financially unable to continue making payments. I am a self employed artist, moved to NYC in 2003 & just couldn't make enough money to get by. With my brother's help I moved to his area of Georgia in Oct. 2004. Once I got on my feet I tried to work something out with Household Finance, pay a monthly payment that I could afford, but they would only settle for a one time payment of $5,000 & I told them that was laughable. Paying them $100 per month would be difficult. They were horrible & I hung up in tears.
    Ugh!!
    Now Midland shows up on my credit report that I owe them more than $15,000. The letter from Mann Bracken says $10,706 (I know that includes interest & fees).
    I don't know what my next step should be.
    Do I ignore the letter? Do I send a validity request?
    I repaired my credit enough, even with the bad debt on my report, to build & purchase a small house this year. Now I'm afraid if they sue me I may lose it.
    I'm really frightened by this company.
    As an artist my income goes up & down, but I barely squeak by.

    Any advice is greatly appreciated.

    Hi the first thing is take a deep breath and relax,Someone here should be able to help you.Midland has a lot of problems.So just calm down and wait.You should some good advice.

    Thanks, I'm trying to remain calm, but I have read some really scary things about these companies. I can't afford an attorney & I really want to take appropriate steps.

    First consult an attorney they usually don't charge,he can advise you.2.see if you can homestead your house.By all means if you do a summons you have to answer it or they'l get a default judgement.DO LET LET THEM BULLY YOU.remember you have certain rights.Remember be calm this will pass!

    Thanks, that's good advice & I will feel proactive. I will look into homestead tomorrow. I just closed on my house a few weeks ago.

    Consult John G. Watts on allexperts. He is a personal friend of mine an a excellent consumer law attorney in Alabama.

    Thanks, I will try that. I attempted to research & find if the Statute of Limitations has expired on this account according to Alabama law, but there were four different lengths of time ranging from four years to ten years. Appreciate your advice.

    In ala the sol is 6 years just ruled on in jan 2008

    Oh great, just got an email from my ex (of 13 years ago) that someone is calling his house in North Carolina looking for me. He said it was a 404 number (Atlanta), so I googled the number & it was from Mann Bracken. That's pretty embarrasing! He called them back to see what they wanted & they couldn't find my name or his number. I have read on emails that one of their tactics is to call & hassle family & friends.....but ex-husbands from over a decade ago??

    If they could call a grave they would.You can send them a limited c&d letter which means they can only use mail to contact you.If they do you can sue them so you would have to doc each phone call.

    Why are we even discussing Alabama? She is and has been a resident of GA for 4 years. And tell your ex to tell them he has no clue where you are, to go pound sand, ...he has -0- legal obligation to give them any info.

    Opps however it's 6 years because it's considered an opened ended account.On jan.24th 2008 the georgia supreme court ruled that it was 6 and not 4.my mind had both states and i said ala.sorry just had a senior moment lol

    Actually, I did ask about Alabama. That was where the loan was originated, then I moved to Ga. I assumed that if they sue me that it would fall under Alabama jurisdiction.

    Pam if you web search this mann bracket you'l see what your dealing with,there so sleazy one branch is sueing the other,So be on your toes.did you check about homestead?

    Yes, I mailed off my homestead application today. Unfortunately in Gwinnett County you can't file on line. I'm still researching my options.

    I didn't want you to think you had no options,my daughter is a straving writer.But you shoukd be more hopeful now that you know you can get advice.Always remember you have certain rights.
