Last summer I had some issues with Cap One. I set up automatic payments with them along with a change of address with one of their wonderful, great speaking reps with the assumption that I was going to pay the minimum payments for 2-3 months then pay the card off completely. Well much to my dismay, the payments did not get processed, I never got bills from them and I didn't realize this until 90+ days later when they called me. I realize I should have checked this a bit better but it was a hectic time for me. So as soon as I hear this I pay the card of twice basically (due to the over the limit and late fees).

How do I get them to delete this? I spoke with a rep once who gave me the old line that it was illegal for them to do this. This is killing my credit score..

Try writing to the executive office and explaining everything.

How would I go about finding the executive office? I faxed them a letter once and NADA! Is there a certain person I should ask for?

Is a letter better than calling on the phone?

One way to get to the exec office is through planetfeedback.

You can also go to their corporate site and look for their officers. If it's a publicly traded corporation, the annual report would have it.

Is there a specific exec I should be looking for?

The general counsel, or just the CEO.
