Got advice from another board -- confused- Help

    The only time you can reaffirm the debt is bankruptcy court. I am not positive it sound like trickery. Which is illegal. To reaffirm a debit after bankruptcy. You will need to go back to court and reopen the case. Just by making a payment does not reaffirm the debt.

    JJgross is incorrect, once a discharge happens, they can not try to collect unless the debit was reaffirmed.

    They can TRY to collect. It may not be legal, and you may be able to take action against them, but that doesn't stop them from trying.

    But the OP didn't have a BK. jjgross was using that as an example.

    Maybe the op should file chapter 13 bankruptcy if he can not pay it in full but can afford monthly payments.


    I do know from reading CB, that it is illegal to go after someone who filed a chapter 7 or 13 bankruptcy if the loan is unsecured. Chapter 13 they can go after them if they stop making payment to the court or other agency in your county.

    No i didn't say any thing about reafirm.Iwas pointing out they will sometimes try to sue even if's it's discharged in bk.I have 2 that our trying to do that now.gpatrick you have to remember when your dealing with ca's and jdb's and some corps,they have done this and continue to do this.It's not trickery it's being an ass***e,they don't care.these people are the people that give the credit world a black eye.And they get rewarded for the company going bk.Read through this forum and see how many people have got screwed over because they couldn't work out a deal with their creditors.So they wouldn't have to file bk

    Ok, sorry about that. Yes, I know they can do that. Just out of curiosity those 2 that are discharged in bankruptcy, did it show that on your credit report? The reason I asked. It will be seven years next year. I wander if they will try to collect or try to collect after 10 years. On my credit report it shows discharged in bankruptcy.

    One does one doesn't one they keep sending a bill so thats three.I know bk stays on your report for 10 years unless you can dispute it off.i believe the trade lines are 7 years.where they discharged in bk?.There is a sol on collection.
