I had a CC with First Premiere and it was charged off and sold twice; once to arrow financial then to full circle financial. Neither arrow fin. or full circle is reporting on my CR but first premiere is. I was wondering what negoiation route should I take to get this particular CO off my CR. Should I PFD the CA or should I PFD OC since the OC is being reported on my CR.
You might try with the oc,my exper. with first prem,they might not deal with you at this point,also full circle might still try to collect after it's paid.The reason why arrow sold it is they felt that they wouldn't be able to collect on it.How old is it?
Arrow Financial never contacted me with any type of written agreement so really I didn't know that they own it. This particular account states: Date opened Nov, 2005 Date of Last Activity Jun, 2006 Date of Last Payment Dec, 2005 Date closed not reported They are also stating that I was late Aug 08, jul 08, jun 08 etc... Is this legal even though its been closed since basically 05'
If it's 1st Premier, then it's legal. However, is the account marked as being in dispute presuming you've disputed it through the CRA's?
Not at all, its showing that the Item has been verified and updated with numerous lates. So, from this point should I PFD both the CA and the OC to see who will give me the best deal to get this thing off my CR.
You can't pay First Premier if it's been sold which it has. Arrow is a debt purchaser. Neither will take a pay for delete and again, First Premier cannot accept it anyway. You best bet is to dispute the account status and pay type with respect to Arrow. It may come off. If not, sue them for failing to mark it as being in dispute under 1681s-2b and violations of the FDCPA. As for First Premier, you'll have to show damages and then, sue them under 1681s-2b for failing to mark it as being in dispute. They're difficult to delete.
