American Express. two cards.. (hope i am right area, newbie member)

    briefly, last june i could not pay amx after 10yrs, I was already about 3mths behind, i sent in 1,000 dollars to each account, but my mtgs were getting behind so i put my money there, I called amx worked out payment arrangemnts, I paid up till Oct 2008 when one day i got notice from credit alert. that amx had charged off both accounts, even though i was paying.it used to be listed as "in collections" I stopped paying, tried to get answers, company called collect corp called, wanted payments, i asked who owns this account, they said american express, so i said I will continue payments if they will change credit listing as in collections, nowa month later two attorneys are calling, i said i will make payments monthly please let me know who owns account, they offered discounts to pay all in full, i said I cannot and I do not want discount, i will pay in full in about 6mths, then can i get my card back? the both said yes, I then got form letters from american express saying how to get my card back, but with no phone numbers, i call american express and they always say the same thing, when the accounts were charged off, we sold them, so I am totally confused, i got an address for amx general counsel, should I contact them there?please advise if anyone knows, should i spend the money on attorney now? I don't want to go to judgement and have them come after my bank accounts ect, thanks everyone,

    Dispute the accounts and quit talking to the colledtor until you find out ownership.You could talk to their general council but don't offer much let them.

    yes, I am even thinking that the attorney collectors, know my hot button is thinking american express still owns these accounts, maybe they were able to get amx to send something, cause there is no phone number on either letter from american express. my reasoning is, i would like to be able in the future to go back to american express get my cards back after I pay them in full, and get my credit cleared up, i acknowledge the debts, i do not expect any discount, and i want to pay them both, but ihave to prioritize, food, utilities, mtg, gas before i can pay them more. but these collectors will hear nothing of that, they jsut want me to agree to a huge monthly payment, one i cannot make right now, ........... also, from the posts i read, i might offer this advice to those who judge others who cannot pay their bills, well, I was always a very responsible person, still am, but collectors treat you like dirt, you start out with them nice, they get all your information then the angry converstations start, i have had to learn to toughen up, anyway, in all the boards i read about mtgs and credit, there are some people who post, look you took out the loan, or the debt, pay it back......... well, until my world crashed, i might have been a bit that way, alot of americans are this way of thinking, but things happen to good responsible people, and I have learned alot going through this I owe alot of money, i do not want to go bankrupt, i never did, i want to pay .... as i can... most people do, but tons of us have been hit hard, and those who have not ,should have compassion. and be thankful

    Your right i've been there and still recovering.Look aig citi amex there all getting bailed out so your paying twice if you have there cc.Some people don't care if you can't pay.Were still a deadbeat.

    Amex hadn't been selling any of their accounts - of course times have changed. I believe though, sometimes, if you call Amex and enter your account number, you can automatically be redirected to their 3rd party collector of the month.

    I'd try calling the general counsel. That's high enough up the food chain that s/he can do something.

    If you don't get any help from them, I doubt that you'll get much help. But the executive offices never hurt.

    HEY THANK YOU EVERYONE... I actually kept calling amx and a very nice guy said again "we do not own these accounts anymore".but here is the number for the general counsel, so, i just immediately popped off a letter (I always send certificate of mailing, i think its better than certified cause no one has to sign) anyway, solved the smaller card today so no lawsuit, but the bigger card, they want a huge payment almost 5,000 per month, i just cannot afford, he said let him know by tues or they take me to court, he said its AMX they will not budge, so??? any suggestions?? thanks again

    I'd CALL the general counsel and talk to him first thing Monday. While letters are fine, they take time that you might not have.

    Tell him that you don't want to consider bankruptcy (DON'T say you're going to file, just that you'd hate to have to consider it), and that if you could make reasonable arrangements you'd be happy to pay what you owe.

    Amx wants $5,000 per month,egads!!

    Thanks for your advice hedwig, i have tried to get through to general counsel, i never got response back from my certified letter either, i called the attorney in new york who said if I cannot pay the $5,000 by the 10th he transfers file to california and they will sue, its strange, i have a smaller amx account and they agreed to my request of $1,000 monthly, which i can do, and i only need 6mths till I can pay, but cannot pay more than $2,000 on the other, they want $5,000 seems crazy to me, but the guy with the smaller amx account said he used to handle larger ones and amx tells the atty try for week or so then we go to sue............... not really sure what to do?get an attorney? i am sure i will be served any day.. anyone, any ideas??

    Well my certified letter to the general counsel came back today ,,, return to sender. i sent it to teh general counsel american express office miramar florida, does anyone know different address or way to resolve this? thanks you

    HEDWIG................ first, i am very appreciative ofyour help. i will send to that address today, I also had read of success when amx client sent a letter to th CEO PRESIDENT. but i do not know if this information is current since her story was from 2003,, any idea??

    I believe that is the CEO's name, and the address looks like the same one I have for the corporate office.

    I can't get into the library I use to check right now. But if you go to AMEX's website (I think the default goes to a sign-in for credit cards, but up at the top there's something like "about AMEX" or "about us" or something similar. That takes you to the real home page. Look for a link for investors and look around there. There's a link somewhere for officers and management. Comes up with officers as default, but there's a link to click for management. The CEO is probably on the officer's page anyway.

    Sorry I don't have time to go look exactly right now, but I really need to wrap some gifts for someone visiting tomorrow and then get some sleep.

    SO...... friday the 19th i was supposed to make payment of 1,000 dollars on amx acct. i agreed to the atty office was great, balance is about 13,000 dollars. but same day i get a letter from another atty , now in calif. they are validating the 95,000 dollars i owe to amx.i pay it all or they are suing me.in calif... i talked, sent letters , emails to everyone listed in corporated offices, ect. requesting to pay 2,000 per month for the next 6mths, then the balance. NOTHING no reponsed, my credit listing with them went from "incollections to charge off, to last week, BAD DEBT WRITE OFF. is this when i have to go get an attorney? a bankruptcy atty, long story, but financial collaspe and i am trying to make best of it, i have payment arrangements with all my lenders, credit cards, but amx, has been impossible, is my only option now to declare bankruptcy? i just need like 6 months to liquidate some things. ug. also someone posted a great letter about stating you are in bankfruptcy to buy about 3mths, should i send that to this atty? thanks for all your help

    Don't count on it Calif. allows bottom feeders to call in on all matters except giving direct evidence. If he doesn't go into court or call the court will take it off
    calender.

    just checking in if anyone has any ideas, i sort of feel like i am in a canoe going down the rapids and I can see that the falls are ahead. looks scary, cause i don't see much i can do to stop going over the cliff..... egads
    I have the two amx cards, one with 15,000 i said i could pay 1,000 a month attorney was cool. the other account is 95,000 and i said i could pay 2,000 per month, (they hit me up on this one with 1800 dollar per month late charges. anyway, i only asked for 6mths . i have not paid since last october 08. well this atty said i need you to pay 5,000 per month, and I don;t have really any income , just selling off assests and that takes time. so he stopped calling, it was 5,000 or we transfer the acct to california where i live and they will sue you, so i did not pay the smaller acct, cause i figured whay should i if they will not accept 2,000 for the larger one, so is my only option now to declare bankruptcy? i would prefer to pay my debts, but jsut cannot come up wtih these funds right now, i wrote many letters to amx to general counsel, exec offices, one secretary for corporate person called christmas eve, that impressed me, but she said once its at this point nothing they can do. ok, merry xmas..........hmmm, what is the CARE program someone mentioned?? so, any ideas?? anyone?? on monday i will contact a couple bankruptcy attornerys, i don't want to have them attach my bank accounts ect. i had a friend who had a judgement and they actually went to his house wit sherrif and office and took computors, paintings, anything they could to settle jugement, i will not let that happen... PLEASE HELP

    I think you have gone as far as your going to go.You should consider filing bk for your sanity.In this time you arn't going to be alone.Take the pressure off my friend they arn't going to budge.

    thank you again, everyone, yes i did call and sent cert letters, i got a call from louise parents office her asst. she is the general counsel for amx, the asst called me xmas eve, but she when it gets to this point they cannot help me. so I will keep exploring, talk to bk atty monday, as for my mental sanity, its not that stressful, for the past 6mths i have dealt with negoiating 14mtgs, and other companies i owed money to, i by no means want to not pay people but its an amazing study in human behaviour when the money is gone, and i cannot say that i would be different, maybe more understanding, like when a tenant cannot pay men, i try to understnd, the solution, be somewhat patient see if they are being truthful, but here in my situation, when you really want to pay, and you are a person who normally pays all of their obligatinos, but your income goes from very high to zero in a matter of weeks, and you try to sell things and they won't sell at any price that will get you any money, well, people get ruthless , they want their money, so you learn to toughen up, cause if you let them, the calls, the rude behaviour will push you over the edge, so i protect myself, work on ways to pay obligations and move forward, and any thoughts, ideas please share , right now, i am just going to get more information from a bk atty, even if its just to buy time............ thanks again

    I'm the one who mentioned CARE, offered by Nationwide Credit, Inc., for Amex. Only a month old program, they tell me. My debt was 20K when I stopped being able to pay in July 08. Interest has now taken it, and including the time with NCI to over 22K. The "program" puts you current if you pay the arrears, which, in my case, over 3500, then scheduled payments monthly. I am still ambivalent as I keep thinking they can/will? knock off some of the interest, but I got a call this morning that they can't/won't do that AT ALL! (However, it is ok that the rep told me last week that she'd call and fax the numbers ((monthly payments)) last Friday and I stayed home and never got a call or fax!!!) They keep telling me I have so little time left, so I know what you mean about seeming you're jumping off a cliff.

    In my case BK 7 is not for me because I own my home. But I've ruled out (for the time being) BK 13 because I would end up paying over 30K for the lawyers to get me zero interest and fees, which the CARE program will do for me without the BK attorney, if I simply buckle to their demands that they won't reduce the interest that has accumulated since they have had the debt.
