Collectors calling

    Hi,
    I am new here.
    I have a question..For the last few months collectors have been calling about a Chase Visa card debt that was supposed to be from a Bankruptcy which was dismissed in 1997.

    No information is given except to tell me that I have a debt and they will take me to Court. They do not identify themselves and get argumentative when I tell them that even if it was my debt the stature of limitations is in effect. In NY it is six years. This supposed debt is from 1998.

    How can I stop them from calling...I have a common name and they could have gotten it from the phone book for all I know. I ask them to send me by mail proof of the debt they say I have and nothing...They just start with the threats of going to Court again...I told them to go ahead, they are wasting their time and mine.

    I did have a Chase Visa card and I did have a bankruptcy in March 1999 and it was discharged in July 1999. The Chase card was included, discharged in bankruptcy...How can I get it through their thick skulls that this debt is not mine.

    You are running into something very shady/crooked. You might have had that card discharged in your filing, but Chase sold a bunch of bad accounts to this collection agency WITHOUT distinguishing that which ones are chargeoffs, which ones are discharged in bankruptcies.
    Send a letter, along with a copy of your discharge, and of course the list of creditors that you included in your filing - and tell them to go f..k off, instead of the normal "sincerely yours".

    Thank you greg1045 for your response. At no time have they said what agency is calling.

    Today a man called and said his name was Chad and that is all he would say except that he will see me in Court when I told him that even if that debt was mine (which it isn't) it is covered by the statute of limitations.
    Another caller said he wanted to teach me about the law. about the last time of use, etc..and I hung up. The idiot does not want to understand that with my bankruptcy, if they are referring to that Visa, that was back in 1999, nine years ago.

    I am guessing that eventually I will be called to Court and they will have annoyed me no end and wasted mine and the Court's time. I am also at present retired and effectively judgment proof..Have no money, savings, property or car.

    I dearly wish I could write and tell them to go scratch but no address or CA name has been given.

    Next time they call ask for their fax number so you can fax them some papers and info on your account.You can then google their fax number and get their address.Then send them a f**k off letter.

    Thank you jjgross, I will do that. It is truly amazing to me that they do not want to make sure they have the right information. They are Neanderthals.

    Google an article called "Prisoners of debt". It's about creditors selling discharged debts/accounts to collection agencies, without actually noting on those accounts that they were legally discharged in bankruptcy proceedings.
