Anyone know anything about these people? The BBB says they've only been around since March, 2008, and the way they've trampled all over my rights shows it very well.

I'd love to get a fax number...or hear anyone's experiences with these folks.

No go...but I did get some more info elsewhere...including two different addresses...one through the BBB and another. I guess I'll send my letters to both places.

Collectman, I just re-read your post, and it almost looks like you're suggesting that I apply to these people...that wasn't your intention, was it?

    Hi Future1966,

Would you please post with the two addresses you used and also let us know if your letters successfully arrived?

We'll just have to wait and see if either is successful. You know, it's been so long since I've done this. I'll be sending a second round if the first aren't successful, but how long do people typically wait to do that now? What's recommended?

I have a feeling that comprehension is not one of this CA's strong suits. (I feel the need to put my "nice hat" on, although it is fitting very loosely today.)

We are a company based in Atlanta, GA. If anyone believes that they are a victim of identity theft and the debt does not belong to them, then please call us at (404) 249-1099 and bring it to our attention so that we may remove you from our database. Writing a bad check can be a criminal offense in some states, however we will pursue civil action against debtors who refuse to pay any outstanding obligation.

That is so typical of a ca don't pay us the money we never lent you and we will sue your butt. You do not provide any goods or services to the debtors ,the debtors did not cause you any damages and yet you want to sue and receive financial restitution. If the banks would offer those who default a settlement offer for the same amount you ca's buy those defaulted accounts for there would be no need for people like you.

The above is the address I used to send a cease and desist letter and a validation letter. Both green cards were returned. I do have a fax number but it is for a Chris. I guess he is the guy that does the hiring for the collectors. Excuse me I mean investigators. If anybody wants the fax number I have let me know.

This is one unprofessional outfit. I contacted the FTC and spoke with an agent earlier this week. The woman I spoke with told me that they have received numerous complaints about Vandenberg. Why am I not surprised?

Last week a woman from VCA called here and before she ever identified herself or her company, she demanded to know my name and social security number claiming that she had a warrant for my arrest in connection with check fraud. I had to laugh. The woman had absolutely no idea she had reached an attorney who knows the law and knows that she was in violation of the FDCPA by her use of threatening and abusive language. When I called her out and told her that I knew she was a debt collector, she stated she was with the legal dept. of Vanderberg and immediately began mumbling. The script she was working from didn't provide her with an option for my situation i.e. "what to say when you realize that you are talking to an attorney." I hung up.

Within less than 60 seconds one of her co-workers called here again (guess they figured I don't have Caller ID) and asked to verify my employment. Again I laughed and hung up. I guess these tactics work on the unfortunate general public who know nothing about their rights under the law.

I decided to fax a cease and desist to them. When I dialed their fax number, I got a recording saying the line had been disconnected. So I contacted them, was put on and off hold for nearly 10 minutes until the famous "Chris" got on the line. Mr. "Chris" attempted in vain to avoid answering my question when I requested that he verify his fax number. When I identified myself as an attorney, he finally got serious, turned on his fax line and my fax was able to go thru.

As soon as they received my fax, they called back immediately to tell me that they were turning my "case" over to their legal department. At that point I was ROTF LMAO because the first brain dead woman who contacted me clearly stated she was with the "legal department" when I pressed her for identification.

These jokers have a real scam going here and don't let yourself be a victim of it. Vandenber has their fax line forwarded to another line with an answering machine that answers: "the number you have reached is not in service, please check to see that you are dialing the correct number, blah, blah, blah." All Vandenberg did was call an out of service number, recorded the "out of service" message and THEN set it up on an answering machine. Gotta hand it to them--quite clever!! What a bunch of slimey p*r*i*c*k*s these people are!

Folks, all you have to do when these sleaze balls call is fax a cease and desist letter to them at: 404-249-9599. Keep your fax machine's transmission verification for evidence. They can call you back one more time to tell you (1) they are ceasing collection efforts, (2) they can take legal action against you or (3) they are taking legal action against you. That's it--no more phone calls are allowed. If they do continue to contact you, record them for evidence and contact the FTC and file a formal complaint.

Don't lose any sleep over their threats either. This small time outfit doesn't have the funds to take people to court for small amounts. It would cost them more in legal fees than they could ever hope to recover.

I received a call from them today

a Mr. Armstrong, claiming there was a fraud case against me. He then called and spoke to my boss and told him all the so called information he had on the case. He said it was with a company I didn't recognize. He had my boss believing it was serious. I'm going to send a cease and desist to them today by certified mail.

Is it illegal for them to tell anyone other than the person they are needing to speak with confidental information anyway? I think I'll be making serveral calls on this today.

    Take action against Vandenburg Chase

I have read many of the same complaints about Vandenburg Chase and have had a similar experience. i filed a formal complaint with the FTC about their illegal practices. Please take the time to file a complaint by going to the FTC website and filing the complaint. This company must be stopped and it will take all of us to do it. The more complaints the FTC gets, the faster they will investigate. This is the only way to stop businesses like them.

    Anybody actually PAY these folk?

I am new to this so please bare with me. I first had contact with Vandenberg, Chase & Associates in Oct. 2008 in regard to a cash advance from 2005. At the time I was going through a very rough patch and was in the process of moving. The gentleman I spoke with (Mr. Jackson) was very nice and understanding and has been whenever I've spoke with him since. I have since been sent to another department where I've spoken with a Ms. Davis and Mr. Peers. Both of these people have demanded my bank account information, debit card, credit card info., etc. I've never ducked and dodged any of their phone calls. I've always returned their calls and kept the line of communication open. I had every intention of paying this debt at income tax time until they began calling my place of employment repeatedly, threatening me with an arrest, and getting down right rude. They called my job 1-26-09 and they were told I was with a customer. The person calling insisted on holding and went on to tell my co-worker in detail the nature of their call. I made the mistake of returning a call from my cell phone and they are now calling that. I have asked them repeatedly not to call my work and because I won't give them bank info, debit card info or credit card info they continue and I was told they would continue. It dawned on me that I've NEVER received a bill, statement or any kind of written notice via mail from them. I went online this morning to find out what to do about them continuing to call my job and I found all kinds of complaints and issues with the actual validity of this company. I would just like to pay the actual company I owe but they have since went out of business and I just don't feel comfortable paying vandenberg, chase and assoc. with all I've read this morning. I did file a complaint with the ftc and I also faxed them the cease and desist letter this morning. Has anyone ever paid these folks, been to court or been arrested due to actions taken by this company? Any info. would be greatly appreciated.

Buy a recorder and tape their calls, let them know that your taping them, unless your in a state that allows one sided taping,They have broken quite a few laws.Send a letter to find out ownership of the loan papers,if they indeed they can collect on this.

If you sent them a cease and desist letter, you have left them only one choice--to sue you.

That's why a cease and desist should NEVER be sent, except maybe on out-of-statute debts. Always send a validation letter and use the wording that is in the FDCPA--it is inconvenient for you to receive calls at any time, at any number.

If wishes were horses then beggars would ride. The problem is that the Supremes have ruled that debt collectors do have the right to sue in the name of the original creditor. Another problem is that just about all contracts carry a clause stating that in the event that the creditor sells, assigns or transfers the debt to an outside debt collector the consumer agrees to pay all collection costs including reasonable attorney fees.

Like it or not (and I don't), the collection of debts is a legitimate business and there is nothing that can be done to change that. Debt collection isn't the problem. How they go about it is the problem and that can be addressed in courts of law just as the collection of a debt can be (and more often than not) is often the subject of lawsuits.

What does one have to do to prove identity theft to your company?

Are you saying that debtors have no other plausible excuse or legal defense against your lawsuits other than identity theft?

    Wow.

I myself am going through this right now. They had called my mother-in-law and stated that i had used her a a reference and that i had commited check fraud. I had never used her for a reference. They had her very worried. So I called them and so far I've dealt with 3 different people. All in a matter of a week. I asked for proof to be mailed to me but they refused. Said that they had sent numerous things to my address, which I never received, and the only thing they would send in something to the county sherriff to have me arrested. I have no criminal record whatso ever. I asked for dates and details and still haven't gotten the same answer. They offered me a settlement and wanted my husband's bank info to post date payments. i haven't wirked since 2007. He will not do this for anyone. I told the gentleman today that my husband won't do that but that as soon as we got our income atx we would pay the amount. He tried to say well then we are going to send it to the sheriffs. I told him that I looked it up and there was nothing they would probably do. Then he started saying something different. Now the amount they say I owe them is $805 from a payday loan of $402 from late 2003, early 2004. Yes that long ago. And they said that they just got it in their office in Nov. 2008. Hmmmmm.
