So FRUSTRATED!!!

    Hi,

    The advice here is so helpful and I have searched for my answer but can't find. Please advise my next move.

    For 6 years my spouse has had a judgement listed on her Experian report that is not her judgement. It is her employer's judgement and it is being reported on her report. She was the onsite employee for a apartment community and one of the ex-tenants sued for the return of security deposit. Sued the management company not my wife but the sherriff served the papers to my wife on behalf of her company and now the judgement continues to list as her's. We have spoken to the supervisor of the local smal claims court where this judgement originated and they agree it is not wife's judgement yet EXP continues to verify it as her's. The judgement does list my wife's name but only as this way.

    "xxx management company c/o jane doe."

    So please we are stumped and frustrated. I just don't see how EXP continues to verify something that even the Courts say isn't wife's.

    PLease how do I get this off???

    Was your wife just a regular employee or a manager?

    Wife was the onsite resident manager.

    Have her contact the overall management folks - let them deal with it. She is just the resident/local manager of the complex.

    Ok. But what exactly can this management company do re; this? And wife no longer works there having left on bad terms (quit, not fired, bad company)
    I am going to post a question on a new thread but perhaps you can tell me what exactly does EXP do when they verify? What are the exact steps and can I demand that they provide us with the name of the person at the court that "verified" this? And can I sue EXP? Seems to me that with the letter I have from them plus their many "verified this debt, debt remains" notations on wife's CR should get us somewhere in Federal Court. Am I right in reading that for something like this FED court would be best?

    First i would say the company would just ignore it.When they verify they usually hire a local who goes to the courthouse and says there's a judgement.You can sue because it's not her's.And i would try to get a letter from the court clerk stating that.You were served because you were in the office.Don't let them bully you.

    Yes - w/ Experian, you will likely have to sue in Federal court at this point.
