Woofer also if you file bk beware of any docs the cc companies even after it's been discharged. From a post i just did i disputed a wama account and chase verified then wanted me to affirm my liabilty to them, which would open it up for collection again. So beware of disputes.
It happens depends on the cc its income so its added on to your wages and then what ever tax that would be.Bk is a thought or a business bk like a agreement between you and you creditors until business picks up.See the big banks get bailed out but your business won't because your small stuff to the elected officals so we don't get any help.Like the cc reform act starts in 2010 after the rate jacks and the cl lowering which lowers our credit scores to not enable us to get decent rates!
They can't call before 8 AM or after 9 PM, but as far as I know (unless it's a state law somewhere) there is no restriction on how many times a week they can call you. It's not in the FDCPA, and as far as I know it's also not in the TCPA.
This is what I was told for my state, and what I have used in a 93A letter. More than twice weekly...VIOLATION HERE. It worked and I got some money ; ) Woofer
Must just be for your state. I never heard of that working anywhere else. In fact, there was a case where a guy had a number that had been a fax number before and someone kept calling it incessantly, and he wasn't successful in suing them, if I remember correctly.
the answers to your questions woofer my problem is with Chase. I owe about 24k. I use citi for points and have always paid in full and on time with citi. I also have HSBC with a 0 balance a discover with 0 and a BP for gas. I have a CAP 1 card under the buss and its at 0 These card total about 100k in avaliable credit. I have 2 Buss loc that total 60k these are at 0 and use my EIN instead of my SS#. I have the abaliaty to borrow from peter to pay paul. but when I was late with chase first time ever they bounce me with new monthly fees and a higher % of the balance. I don't want to do balance transfers and complicate the problem . eq is just and abreviation for equipment. mostly stuff I buy to resale. my last payment to chase was in december and was for 500. on a 24k balance and my jan bill came they wanted 1200 a month and 10 a month for the right to have the card. I have recieved about 4 letters saying pay now to save my credit and dozens of calls . I explained that the new monthly service charge just to have the card was wrong to a supervisor ( this was soon after the increase on my statement) and he told me they have the right to change anything in the account because I signed an agreement with them when i took the card out( 15 years ago). later I have explained my "hardship" and they offered me a deal but want me to catch up the account before they will lock me into a low interest low payment plan( I asked to close the account They also said they would close the account as soon as I had it caught up ). I asked for a contract stating the "deal" they offered me and was told when the account was caught up in 3 or 4 months I would get a contract . I was very suspcious of they way this was put to me by the lady. several of the calls before that were less than polite. I am suspcious because of the supervisor I spoke to early on and I don't trust them. now after a few months I can't catch it up . and I am not going to borrow from a good account to pay them for jerking me around after 1 late payment. things really are tight here. and I can't see paying them with borrowed money exspecially after they treat this like I have always been a problem. I have opened another account at another bank for checking under my nickname and under my ein# I just put a couple $ in it and am using it as a place to cash checks that are made out to me and not the company. not cheating on taxes just trying to get ready to make a smaller footprint so to speak , if they start looking for assets. I am able to keep able the other bills paid I am not incorperated but do buss under a company name /DBA . Changing my phone# isn't really an option . but I do have caller ID on all my lines. I am in a small town and I am worried about my reputation. I am amazed how quick and tricky and nasty some of this stuff has been. Just trying to figure out what to do next. thanks Jerry
