NCO/Capital One

    I own a small business that has a credit card, guaranteed personally by me. There is a balance of about $5k on the card. Since the gas prices of last summer, the business has been in severe trouble. The main 2 deliquient creditors are the IRS and Capital One.

    I am dealing with the IRS, and so far they have been very willing to work with us and set up payments. Capital One is 5 months behind, -- I had to get the IRS handled first.

    So last week I called the agency that has started calling, NCO. I had managed to gather $200 to pay on the card. Thought I was doing right by calling and telling them it was coming and I would pay as much as possible every 2 weeks. The agent said "great, I'll note it and stop the calls for 2 weeks." The calls never stopped.

    I talked to another agent tonight. He claimed to have no record of my call(some bs line about they don't write notes on accounts in case other agents get it wrong) and if I didn't pay more by Tuesday he would turn the account over to an attorney. Then he told me that if I paid $50 he would note on the account for no calls for 30 days(what happened to no notes?). I asked for his id# and an address to communicate with them(I don't recall seeing anything in writing from NCO). He refused. I asked for his manager, and the manager refused to give me the mailing address. He wanted to know what I was sending-I said I thought I had the write to request that all communication be in writing? He said you write to Capital One not us.

    What do I do from here? I explained the situation and that there are no assets, we are trying to increase income and the IRS takes precedence, but he has to have $$. I feel now that I need to do this in writing but how without an address? Any advice to the newbie would be appreciated.

    They have to notify you in writing so their in violation of the fcdpa No ifs ands or buts.Send them a dv letter.Also google the name and you'll see who your dealing with.

    Send Michael Barrist, their president, a letter and NCO will go poof. You may have a window wherein you can deal with Cap One directly then.
