    Cap1 I really wish you would clue us in to HOW this guy got 80K from BoA. Why not tell us if it is a known thing.I mean we are all here to help each other are we not? If you don't want to put it on here send a private message to me as I would really like to review it and learn for the case. Woofer

    Okay these are the post/threads that really get me confused. After months of worry, calls, research, I have decided to declare bankruptcy. A few months ago, after getting advice here and reading, I decided to fight and not fold to the cc companies.

    Well, it's taken it's toll and I'm wondering if possibly 3 more years (or more) of dealing with compiling possible 12 inch thick court cases against 10 creditors is something I can really stomach while trying to move on with my life.

    I have written many DV letters, and also consulted with a lawyer about a NAF situation in which I took on the letter writing myslef. I'm not dumb, have great research skills and a graduate degree. Would I rather NOT go through the damage of bankruptcy? Of course, but I don't know if I have 10 hours a day to work on cases to fight 10 creditors for years. I've spent so much time on this all ready that could have been devoted to working on my business and building income, that I see it damaging me further to take this route.

    My debt is related to a struggling (but not failed) business. Credit is in my name and/or personally guaranteed by me. BK lawyer says it all goes in one pot, even with a corp, in looking at income and assets, in a Chpt. 7.

    Everyone has to chose for themselves the best route. I appreciate the info that if I do want to fight and put the time and effort in, it's something I can try. But, I also appreciate the input from other who have chosen BK so that they can move on, and come out the other side. This really helps.

    I just think that instead of saying it's hard to believe anyone would declare bankruptcy, then describing the hours and hours of work and sacrifice involved to avoid doing this, it would more more helpful to hear, "there is another way if you are willing and able to do all these things and spend this amount of time, AND be comfortable dealing with courts, lawyers, etc. on an ongoing basis for perhaps years", would be more helpful.

    There is a cost to everything and at the end of the day, that's what must be weighed. I'd like nothing more than for the CC who raised rates and lowered limits on a good customer, to get screwed while I come out on top, but I just may be the one who's screwed even more if I put myself and my family thru more years of this.

    Good luck and keep us posted i think you did the right thing for you and your family,you will recover from this,and spare the family from seeing you suffer,it wasn't an easy choice i know.
