Okay Folks here's a doozy... I have a civil claim judgement. I never received a notice. I was never aware of the judgement until I checked my credit reports. This judgement is dated Dec 01, 2003 in Florida. I currently live in Austin My questions are: 1. Will this judgement automatically fall off in 2010? 2. Is there a strategy to remove the civil claim judgement from the credit reports before then? Many thanks, =)P
1.no and depending on the state it can go on for 20 years. 2.Not really a doozy if you lived in florida you got served at an old address. 3.Is it yours? 4.You might try to get it vacated. 5.I would consult with an attorney!!
If you think it's not really yours, try disputing it. If it comes back verified, send a procedural request to see who they verified the information with. Have you ever lived in Florida?
I believe that if I were you I would just let sleeping dogs lie if at all possible. Here is why. Statute of limitations for enforcement of judgments in Florida is 20 years. In Texas it is 10 years but statute of limitations for credit reporting purposes is only 7 years. Dispute it and they just might come after you to enforce the judgment. If they did that they would have to file a case in Texas to domesticate the debt into Texas. You would then have another judgment in Texas and a new 7 year reporting period plus another 10 years they could use to enforce the Florida judgment. Then what would you do?
