I have successfully disputed a bunch of stuff directly with the CRAs and many things have been deleted. I have been reading about 'Validation' on the boards and have looked at the sample letters, but I am still unclear as to how to go about doing this. I am unable to do the validation within the 30 days of receiving a letter from the CA or OC because honestly I didn't pay that much attention when i got that stuff. When i recently got my cr, i used that to write the disputes that i sent to the CRAs. So here are my questions: 1. Since many CAs and OCs did affirm the debt i disputed with the CRAs, how do i go about requesting validation from the CAs and OCs? Some of these are debts that i have known about and others are not. Would i simply just send a letter requesting that they provide me with some 'proof' that i owe them this debt and hope that they don't respond??? The sample letters don't really seem to match up with my situation, but i think i could figure out my own letter using parts of them. 2. Is there a real risk that they will try to sue me and get a judgment against me if i do this? I don't want to be served as none of these are currently judgments and i would not like to risk them going to that ... how much of a risk do i actually have? thanks.
Hi jjgross. OK. here is what i have. This is me and my wife's stuff. These are the collections: National Credit - went there 2/08 never made a payment Central State Rec - started 3/04 - never made a payment Credit Bureau Central - started 12/04 - never made a payment Direct Management - started 4/06 - same Central States - 1/09 - same and i have a few other accounts that are paid off but they are still reporting recently and negatively but showing zero balances.
Do you know what the CA is collecting for? And when did you last pay that account? That's what will determine the SOL in most cases. OCs aren't required to validate. But most of these don't look like OCs to me.
medical bills, phone bills. the dates that i gave are the dates it shows the accounts where taken by the CAs. I understand that i cannot ask the CRAs to validate. I don't know how to determine the SOL on these accounts. I didn't pay attention to any notices we got from them as we were unable to pay them at the time we got them and i was not aware of the validation process when we got them. so, requesting validation within the 30 day window cannot happen. Now that i have my credit report, can i request that the CAs validate the debt? I just don't want to risk them trying to take me to court and filing a judgment against me. I am not saying that i don't owe this or that i will not pay it. We would like to buy a house and i am trying to get my credit score up over 620. I thought i could perhaps get a few more of these things deleted off my report if i requested validation from the CAs and then disputed again. But i was reading on the web and this site and then started to worry about these CAs filing judgments. Also, the example letters on this site dont really fit, but i think i can work something up. I ovbiously don't want to lie to the CAs, but i don't want them on my credit report anymore either.
First of all, don't ever use a sample letter. Keep it simple and in your own words. How long has it been since you had the medical bills and the phone bill default? That's what determines the SOL, not when the CA got it. They change dates (illegally) all the time, so you can't go by that. You can request validation at any time. It's just that they don't have to respond and they don't have to stop collection activity. If you can pay it, don't worry about them getting a judgment. You'd be able to settle before going to court in just about every case. They won't spend money to take you to court if they can get you to pay.
