Just joined up and hope to get some insight from others going through this living nightmare. Just got a call from my Lawyers assistant regarding a wage garnishment for school loans. A little back story... I filed CH7 Bankruptcy and received a discharge of all debts, minus the school stuff etc. I got one letter about wage garnishment and I immediately went back to my lawyer to see if he could talk to them and see if we could compromise on a decent payment each month. He sent them a letter etc... I just heard back that the wage garnishment has already been filed, they are only waiting to hear back from my employer. WTF? Nothing can be done? $500to my laywer to send a letter and get nowhere? The garnishment will be for $435 month, I can add $50 on top of that and within 9 months be eligible for a review under the Rehabilitation act, not sure what all that is about? Do I do the extra $50 or not? I will need to check into that. My question here is, just how in the hell do they come up with such a massive number? $435 freakin dollars a month....Jesus H. Christ...that is my car payment, am I supposed to give up my car? I sent ym lawyer an email asking him how they come up with this number, I don't remember telling him my salary, I would asume it is based off that right? But $435? Damn man!
You just found out that after a bk,all you had was a lawyer interested in just the bk.I would try to deal with this with the other people,but your stuck for now with the 435 or more for now.
Actually, my lawyer just emailed me and said "I did not supply them any information with respect to your pay and necessary expenses. By the time they got my representation letter and we were able to get them on the phone, they said the "order had been submitted". He is going to try to contact them again today and see if we can work something out. He doesn't know my salary nor does he know where my new place of work is let alone them. So they just pulled a number out of thin air apparently.
If they've actually served a garnishment order on your employer, I'm sure the employer had to disclose your salary. They are allowed to garnish a certain percentage of your salary. Since it's a federal loan, they can probably get your employer information from the IRS or Social Security.
That is just it, they do not know my employer nor my salary etc. They must think I still work at my old firm.
Have you just started working there?Remember they can get info almost at once.Remember your dealing with the feds.If your having taxes withheld they got it.
That's what I mean. If the new employer has paid you and sent a statement to the IRS (which they have to do every payday or every month, depending on the size of the payroll), they will know where you work. They don't need you or your lawyer to tell them. They'll know.
