Bad news for JDBs in So. Carolina

    I don't see how this is bad news for buyers in NORTH Carolina :). For every account that is purchased, a chain of title, and/or an affidavit should come with it showing the transfer of ownership and legal right to the account (and if the document doesn't come with the account, an intelligent buyer will order one before filing a lawsuit). The SOL issue is a given in every state.

    That's what I thought too, until I re-read it: "The law also prohibits debt buyers from filing or threatening to file a lawsuit when barred by the statute of limitations."

    As it stands now, the SOL does not prohibit someone from filing a lawsuit. It just provides a defense that can be used against the claim.

    Whoops, sorry about that, I didn't catch it.

    Unless someone is recording the conversation, good luck proving they said they were going to file.
