Assest Aceptance did not send me the proper validation, but another bill. I sent them a DV letter about 15 days ago, and all I got back was the same bill from them. What letter should I send next? Thanks
1st, remember that the standard for validation (insofar as the FDCPA is concerned) is pretty low. They minimum they need to provide is the name and address of the OC and the amount being collected. That may not be enough to prove it beyond a shadow of a doubt, but just that minimum of information satisfies the FDCPA validation requirement. If the CA did not provide that minimum of information, you need to see if they are reporting this on your credit report. If so, dispute the entry with the credit bureau. If the CA does not remove the entry, you have grounds to sue them for continued collection before validation.
What they sent me was a bill with the OC name the original amount they say I owe and the new amount with an old account number and a new account number they don't even have my name right. Is that enough for validation?
It sounds like it would be sufficient to meet the FDCPA requirement for continued collection activities. You should still get a copy of your credit report(s) to know for sure and to see if they are reporting it accurately. What you do next depends on what you want to accomplish. (e.g. be a pain in their butt, pay the account off, negotiate a deal with them, etc.)
There are many ways. It all depends on how much time, effort, and money you want to put into it. Spend some time and peruse some of the postings on this site to get an idea of what some of the different options are. Most (although not all) involve lots of legal research and some time in court.
