Hi all, New to the forums, but briefly reading through, it would seem that everyone is pretty knowledgeable here. So I present you with a problem I have been long dealing with. My father lives with me and he had a judgment against himself for non-payment for lawyer fees in 2008. My father's names is as below: First: James Middle: Joseph Last: James My name is as below: First: Joseph Last: James Since my father lives with me, we both have the same address. The judegment was again my father, but the law firm proceeded to placed liens on some properties I own (solely mine), even though I had not done any business with them. I communicated this several times to the law firm (even sent copies of my and my father's drivers licenses) and they stated that they did not make the mistake, but that the County Clerk incorrectly filed it. I called the County Clerk and explained the situation. The County Clerk said they understand the mistake and would verify with the law firm. When the County Clerk called me back they said they would be unable to do anything until my father's fees to the law firm were paid. I'm not sure what to do here. I've sent much communication to the law firm and they refuse to correct their error. The County Clerk will not fix the problem until the law firm gives him the go ahead. When I approach lawyers with my case, they call the law firm to mediate and the law firm tells them I don't pay lawyer fees, and they drop my case. It's like they trying to blackmail me into paying my father's debts. I've filed a complaint with the FTC online but never received a reply. In the past two years I've had college and bank loans denied because of this item on my credit file. You guys have any recommendations on what I can try next?
You need to call an attorney, if you need help removing it from your credit report. I can help you. There is no way they can attached a lien to your house legally when it is clearly not yours. I would contact an attorney and threaten a lawsuit if they don't remove it immediately. Make sure everything you do is done via certified mail so it can be tracked.
Contact your state attorney general,or your local da.You can also sue pro se.it could be harder to do it your self.
Thank you so much for both your replies. I do not see myself suing the law firm, but I would like to get this off my credit file. CreditRepG mentioned I should get an attorney. Due to the cost, I will do that only if I deem it necessary. As jjgross has mentioned I should write my State Attorney General or DA. It has been about 1.5 years since my last communication with the law firm. Should I try contacting them before contacting the AG or DA? Their last letter to me was to stop writing or they would sue me for harassment. Also, should I write to the AG or DA, or should I hire an attorney to contact them? If I should write to the AG or DA, what should I say? I can explain the situation, but should I send them the judgment against my father, my driver's license, his driver's license, etc.?
