Question on a cell phone CA

    I brought up my credit report and there is a Calvary portfolio services for 375.00 delinquency reported on 2007. The thing is its from a cell phone account with Sprint back in 2003. how can they repost it under the year 2007? can calvary really do this and push the reported date that far forward?

    They can do anything they want to do. Absolutely anything at all!!

    The question is whether or not they can do that legally or not and the answer is that they cannot do that legally. In fact, it violates both FDCPA and FCRA. Then the question becomes what are you going to do about it? Yes, you can dispute it with the credit bureaus but what will you do about it if they refuse to remove it?
    And if the credit bureau removes it what will you do then?

    There is another and far more serious aspect to this type of situation that should also be considered and that is what will you do if they sue you for the debt?

    People come to this and other forums bragging about how they got something removed from their credit reports but getting stuff off your credit reports is not a cure for the underlying possibility which is a lawsuit to collect the money. Just because we get things off the credit report does not stop them from filing lawsuits against us.

    The fact that a debt may be long past the statute of limitations doesn't stop them from filing a lawsuit either. Credit repair is just the first baby step yet most people in these forums seem to have the attitude that getting things removed from one's credit reports is some kind of major victory which it most assuredly is not. In fact, getting stuff off credit reports is such a minor consideration that I don't even bother with it.

    I say that the way to do credit repair is to force them take it off. After all, they put it there so make them take it off. Quite often forcing them to take it off ends up being far easier than trying to dispute it off which often results in endless letters at $5.00 a pop and getting no results for the money spent. For the same money or less one can force them to take it off and pay for making them do it.

    If you only dispute it off they are free to do it to someone else but if you hit them hard where it hurts most they might think twice before doing it again to someone else.
