I am an unemployed single mom with two children. I have a cc debt I can't pay right now. After receiving harrassing calls from the c/a I sent a letter disputing the debt because the bank they say now owns my debt (Bank of A) is not the original bank (Wachovia). They returned copies of old statements to me as proof of the debt. Have they met their obligation of proof? I live in the state of NC. Thanks.
Was the account in good standing at the time BOA acquired Wachovia? If not then BOA does not stand in the shoes of the original creditor Old statements? How old? When did you make your last payment on the card? NC has a 3 year statute of limitations according to Lawdog.com. You may have a SOL defense.
