I need to know how, if it is possible, to get something off of my credit report quickly. Last year, I was sued by Capital One. I ended up winning in court that I owe them no money, and have the court paperwork with the account number, amount, verdict and everything. Now my wife and I want to get a mortgage to buy a new home. My FICO is at about 650 and they need it to be up to 680. A big part of the reason that my score is low is because Capital One is still reporting that I owe them this money, even though I won against them in court. They also updated it to make it look like there was recent activity. I provided the court documents to the credit agencies (Equifax and TransUnion) and they responded that they need the following: "The credit bureaus will not accept the documents provided they will require a letter from Capital One on their letterhead, dated, signed, addressed to the consumer, the account number listed on the credit report stating how the account should be updated." I know that I can contact a lawyer and sue them to take this off, and will start doing that. But I was hoping that there might be a quicker way.
Sounds like the fastest way to get it corrected will be disputing it through Cap One and getting them to provide the CRAs with the necessary documentation to remove the negative listing. If you won the case, then what is there for them to argue? They'll need to comply and update your account so it's reported accurately to all the bureaus.
What was the basis of the decision that you "owed them no money"? Was the debt declared invalid, or did you not have to pay for some reason like it's past the statute of limitations? If it was the latter, they are quite possibly reporting correctly if they're reporting that it was charged off, because it was. We really need a little more detail about the basis of the suit and what the ruling actually said.
Great point Hedwig...I didn't think of that. Hopefully the OP will come back and give us some more info. on the case.
I've disputed this many times with the CRAs, and each time Capital One provides them with some "proof" that I owe the debt. Most likely, it is the same proof that they tried to present in court, an affadafit signed by one of their employees saying I owed the debt. I even had these disputed by a mortgage company that submitted all of the court paperwork, which was not accepted by the CRAs either.
The debt was declared invalid, the verdict was entered in my favor for no amount. They produced no acceptable evidence or witnesses to prove that I owed them the debt at all.
Then they need to update their reporting. Try going to an executive, like their general counsel and send them the paperwork. Cap One will have to update the credit bureaus, but some customer service rep is not going to do it.
Thanks, I found some contact information for the VP & General Counsel at Capital One, I will try sending him a letter with the court paperwork.
