    Note: This page addresses debt which is with a collection agency. For debts still with original creditors (still with the credit card company and NOT with a collection agency), go here. If a debt is with a collection agency, the original creditor (OC) is not going to deal with you. The OC has collected its tax benefits under US tax law for bad debts, and "cut the ties" with the debt.

    How do you know if your debt is still with the original creditor (OC) and not with a collection agency? Simple: call the credit card company.

    representative states : IT S WITH AN OUTSIDE AGENCY â?? & AMERICAN EXPRESS NO LONGER OWNS THE DEBT

    BECAME EFFECTIVE â??( that nco owns account ) MARCH 15, 2010

    so does NCO not validating my debt make them sueable now?

    thier( nco) letter recieved 3.19.2010

    requested debt validation recieved via certified mail 4.19.2010

    its been over 30 days w no response from NCO

    ARE THEY NOW IN VIOLATION OF THE FDCA?

    What has NCO done since their receipt of your DV request? You mentioned phone calls; is there any written correspondence?

    Not based on what you describe.

    There is no requirement (30-day or otherwise) for a CA to respond to a request for validation. None.

    The FDCPA just probhibits "continued collection activity" until they respond with validation. You may never hear from them and that's just the way it goes. OTOH, they might just file suit.

    But, until something happens, there's not much you can do so don't sweat it until they call you, send information to a CRA, or send you validation.
