Hello, I am new to this board, I recieved a letter in the mail yesterday that I was being sued by Blatt, Hasenmiller, Leibsker & Moore. This IS NOT a summons, it just simply states that there was a lawsuit filed against me by this lawfirm on behalf of portfolio recovery associates. Then they go on to say that they want me to call them to discuss "your proposal for resolving the lawsuit." It was not signed by an attorney either. So after this, I went and looked up on my local court website, and sure enough they have filed suit against me a week and a half ago, and I still havn't been served, the court date is in the second week of March though. I really don't even know what this account is for. So I have been scouring the internet for about 30 hours straight trying to figure out my next course of action. I ended up here, started poking around and it seems you're the person to talk to. If there is any way you could give me some advice I would greatly appreciate it
Do you know what this is regarding? How much is the amount owed and to whom? It seems that your debt got pass on and sold. You still have time to send them a letter of validating. Give us more detail?
I am not exactly sure which cc account this could be, I have narrowed it down to 2. They never state which one. They say they are representing Portfolio Recovery Associates. This is a debt that is over $3,500. It is also within the statute of limitations as well. I thought it was a waste of time to send a validation letter after the law suit was filed? Still have not received the summons though. I don't know how long before the court date they are supposed to serve me either. I have been all over IL civil code trying to find an answer and cannot find one. I have read a couple horror stories where they fake serve people so they don't show up to court, at least I know this is coming. I just need to know what I should do first. I want to see what the complaint is, but not enough to go to the courthouse and serve myself! This way if they don't serve me, I show up for court when i'm supposed to be there surprise them and file for a motion to dismiss because they didn't serve me properly.
My understanding is that it can often take 2-3 weeks to be served, and every jurisdiction will have different rules for how long they have. So, check what the rules are in your jurisdiction first, or just call the court and ask if you can't find the info. on your own. If you're worried about going down to the courthouse yourself, have you thought about just convincing a friend to go down and make a copy of your file so you can start preparing now for when they do serve you?
