I have an account that's several years old. In fact, it's past the SOL for collection. About a year ago, the CA started reporting regular monthly payments. I disputed with the CRAs, and all the CA sent back was a paper showing my last payment several years ago. Clearly this doesn't support their claim of recent payments, and the CAs are now obligated to remove incorrect information from my report. Except they didn't. The dispute process is so laughably automated that they're claiming the CA's documentation supported their claim of recent payments. I'm sending a final letter to the CRAs (which will include the CA's documentation) demanding removal of the inaccurate payment history. I'll give them a generous 60 days to fix my report, then I'll file suit. Has anyone sued over inaccurate payment history? It sounds like it's blanketly covered under the FCRA, but I want to make sure there isn't some exclusion for history. Thanks.
How annoying! I agree with you- I don't see why you couldn't sue due to incorrect payment history. I've never heard of any sort of exclusion for that, but I've never done it myself. Have you had any direct communication with the CA yet regarding their inaccurate reporting of recent monthly payments?
Not the CA, just the CRA. But that's a good idea -- a CMRR to the CA might be prudent, especially when presented as evidence that I've taken every reasonable step to resolve things nicely.
Who knows...they may even correct their mistake after you directly contact them. Plus, I agree, it can't hurt to have documentation that you've tried every possible angle to get the errors fixed.
