Hello All, I have an Amex account that I have had since 2003 and in 2011 it went into CO status. About 5 months ago I settled for less than the full balance that they claimed I owed. Amex is reporting this on all 3 cra's as a paid collection (settled for less than full amount) They are not reporting DOLA, DOLP, Charge off amount $0, High CL $0, CL $0. I have had this account since 2003 so it has a lot of history and yet they are not reporting this information. I disputed this as inaccurate and incomplete and Amex verified it on all 3 disputes. I'm Getting my intent to sue letter ready but my question is, whenever this account went into charge off status are they still required to report all of the information that I mentioned above? Am I missing something? This seems too easy and I cant believe that a big company like Amex would screw up like this. Any advice would be greatly appreciate Thanks, MrMatt
A charged off account has a DoLD. You need this to determine when the account will fall of your reports. As far as high CL and CL I agree that they should be reported as well -- not that it would affect your score, but simply that the account is not reporting accurately. You may, just to give yourself more ammo, send a CRRR LTR to the OC disputing the reporting of the account, AND in that same timeframe, re-dispute with all 3 CRA's.
Mindcrime, Thank you so much for your reply. Im sorry I should have stated in my first post that Amex verified the trade line twice on all 3 CRA's. This is what has me puzzled as to why a big company like Amex would think that this tradeline is complete and accurate. Not once but twice! But by verifying this twice means that they violated the fcra twice. So I have everything printed out where they verified that the tradeline is hunky dory and ready to come at them with guns a blazin. What do you think?
Do any of your reports have a "this account scheduled to be removed x/201x date? If so, then a DoLD is reporting somewhere which would definitely be the biggest issue in my book. You're referring to section 623 (a)(1)(B) of the FCRA. Your situation is somewhat similar to mine in that its the OC reporting incorrectly....in mine, I wrote the OC CRRR, OC responded with detailed account history and actually gave me the evidence against them! ....they were reporting to the CRA one way, and gave signed LTR stating account is another (way). This made it easier, somewhat, in finally getting them to agree to delete. This is why I suggested sending a dispute LTR to OC, sometimes a little ignorance on their part, goes a long way. I understand that you've already disputed twice, but its still not too late for you to do this, and to dispute once again.
Oh I gotcha. Its been almost 10 years since I've had to deal with this kind of stuff. The process is all starting to come back to me slowly LoL. You have to point out to them what your complaint is and wait to see what their response is. Basically give them enough rope to hang themselves with. Even though they already have violations it probably wouldn't be a strong enough case to lay in front of a judge at this point. I almost missed a very important step in this process. Yes, I would just, in my letter, point out that they are reporting this account incorrectly and ask for verification of accurate account details. (Use your own words however you feel comfortable). Hopefully you will receive an account history summary, and it should have the last delinquency date, among other things. Then if it came down to filing suit, it's nice to have evidence from the OC proving one thing and reporting to the CRA, another. But before lawsuit time, I'd contact the OC and try to resolve asking for deletion. You're welcome. It had been over 10 years myself since I've been involved with it all, and not only do we lose the feel for the process, but the process itself has evolved as well. This board has some members that have been here all along and have continued to help others throughout all these years, and I'm grateful as well to those few who have helped me remember, relearn and learn.
