    Hi again,

Do I need to wright down the original debt balance on the letter so they know that the settlement offer that I am offering is for the original debt balance ?

    What you think please?

    Thanks again.

No, you don't, you're not stating "I will offer you x% of x dollars", you're simply offering a lump sum of x to settle account in full and to delete.

    Hello again,

I have item that I disputed and now it saying on the report this item was updated on 06/12/12 but this item satred reporting in 01/07/10 .

My question please: If you disputed item on your report those it start the SOL time or The 7 years time that has to stay on your report at all over again ?

    Thanks guys

Disputing an item on a CR has nothing to do with the SOL. SOL pertains to when the debt first went delinquent; disputing, or saying "it's not mine" doesn't restart when the debt first went delinquent.

Updated on 6/12/12 simply means that's the last time the CA last reported something to the CB about your account.

I was wondering for account goes to A DEBT COLLECTION COMPANY for how long the account has to be pass due befor the original creditor hire a debt collector. The reason I am asking is because I had some work done in December,2012 and I did not get the bill antill January or early Febraury any way I made a payment on febery 25 and on the 3/8/13 I get this letter fro debt collector saying : Our client has informed us that thier records show that your account is seriously overdue. The purpose of this service is to protect the interest of both the debtor and the crediytor. YOU CREDIT IS YOUR MOST VALUABLE ASSET!!! We arge you to CONTACT THE CREDITOR shown below or our office regarding you account. The date on letter is Febery 26 for the full amount, but I made a payment on the 25 and the lady did not say any thing I asked her do I have t make a full payment today or just half and she said half it ok, but nothing about clollection.

Is this mean that this collector reporting on my credit report now ?
My account is not even 120 days overdue, and I made a payment ?
Do they have the right to do this in short time even I mad the payment and how about the collector asking me for the full amount ?
Do I have to disputeand validity the debt because the want something in 30 days to validity the debt on the letter ?

I was going to pay the rest of the balance even before I received this letter on Monday 3/11/13 any way.

What I should do now please?

I just hope they are not reporting to my credit report sinece I just canceld my Euifax credit report I can't tell if there on there.

    Thanks for any respond guys.

I don't think there is a set timeframe as to when a creditor sends an account out for collections.

Typically a revolving or installment account would wait anywhere from 120 to 180 (typical age for a charge-off) before sending to outside collections. This is because it's in their best interest to keep you as a customer (all those interest charges, late charges, etc that keep adding up) and on a revolving account there's a very real chance of further future income from you.

If this is a doctor/dentist/one-time service you had done, the account could go out for collections after 30 days. Those are typically balances that are due at time of service or due on receipt.

I would suggest contacting the OC and explaining the situation, this sounds like an honest mistake/oversight and they'd likely be willing to pull the account back from the CA.

I thought you got in on a $2 off p/month promo on the Complete Advantage Plan?

No I am still thinking about the $ 2 off ,but now I feel like I want to get all the 3 report daily espacaily now with this collector sending me a letter trying to collect and I don't know if they are reporting to any of credit beraus. That why I want to go with USAA OR ELIMINATEIDTHEF or something where I can pull daily from all the 3 beraus.
Any way this is from Anesthesiology after surgey and I made a payment already just don't make any sience.
My question now do I need to validate this debt with collection or do I just deal with the surgery centre original creditor because I now they will take a payment on Monday when I calle them. After they take the payment Do I still have to deal with the collection too ?
    Thanks guys

Subscribing to EQ's CW w/monitoring or Complete Advantage/Premier plans monitors all 3 reports, so if a CA reports to EX or TU, you will be notified, and you have the ability to dispute the account with any or all CB's. I went to USAA's credit monitoring page and didn't see a daily pull option; maybe there is, but I just didn't see it.

I wouldn't just blindly pay the OC. Talk to them, make the understand and agree that it was a misunderstanding and to pull the account back (sounds like it's only assigned, not sold). And no, once they pull the account back, and are paid, the CA goes away.

yeah, the USSA website they are not offering that deal any more I think the ELIMINATEIDTHEF
the only one the offering that for 12.95 I think it good deal.
So if the account it only assigned to the collection is that mean they don't report to the credit berau ?
Is it the only time the report it is when the buy the debt?
    Thanks

No, a CA can report whether it owns the debt or its just assigned.

Was this 40% of the debt now owed (w/ interest) or 40% of the original debt owed?

40% of the original debt owed.

Last time the send me an offer they want 65% of debt now owed with interest. I think that just crazy.

If I had that kind money I will be in better shap, and I don't even know if they are allowed to add all the fees and interest almost $ 5.000 when they take over in 2011.

    What you think?
    Thanks

Have you checked the original agreement/contract with the OC to see if the fees added are allowed?

    samira1973 Well-Known Member

I have not I need to check for those fees.

Any way I called on monday the Anesthesiology surgery centre to make the payment and I ask them about that collection letter I received from this collection office that is in the same town. They do send files to that collection
office, but first that collection office has just to give waraning to people and that what hapend with me they just send me waraning letter from the collection and they said they will talk to them and let them know that my account paid.

I have a question for you please : so do I still have to respond to collection with DVD letter because n letter it saying We arge you to CONTACT THE CREDITOR shown below or our office regarding you account you have 30 to validate this if not we assume the debt is yours ?

The lady told me the will talke to them I just don't if I need to do any thing with this collection before 30 days ?
    My account paid in full.

    Thanks guys

There's no point to a DV LTR, the debt is brand new, you already made a partial pay on it, and you're paying off the balance it seems.

    CA's are required to put that in their initial communication....a statement that unless the consumer, within thirty days after receipt of the notice, disputes the validity of the debt, or any portion thereof, the debt will be assumed to be valid by the debt collector;
...section 809 (A) of the FDPCA.

But from what I recall of their letter that you posted here, this CA took a very soft approach on this to you, and I'd venture to say you'll never hear from them again.

Hey thanks for all the help.

I have some other questions: What you think will be the worst thing to have on your credit is it collection or bankrupcy

and if you have one f them on your crdit report witch one you will be able you to get loans from lender I am talking about any type of loan. I know any of them on your credit report is bad, but I seen a lot of people geting loans even with Bankcrupcy on their credit report.

Witchone will hurt more on your credit score Bankcrupcy or colection ?

    Thanks

I have never filed for bankruptcy, nor do I have any personal knowledge of someone who has. I've read the stories, like you, aboutvthose who have filed for BK, and then within months of discharge, begin receiving offers for credit cards, and even financing a new vehicle.

I suppose it depends on how much debt you have, whether you're being sued over it, and probably a number of other factors that differ from person to person.

Collections, charge offs, late pays all affect your score. Time is a factor for both your score and I would believe, consideration from a new lender. A consumer with a collection account from 6 years ago is likely to be looked upon differently than one from last month.
